RELEASE AND RE,CONVEYANCE OF EASEMENT
COMES NOW the City of Bozeman, 121 N. Rouse Avenue, Bozeman, MT 59715, a
Municipal Corporation of the State of Montana,the GRANTOR,does hereby release and reconvey
the following described easement unto Four Corners Construction,LLC, with a mailing address of
2264 Jackrabbit Lane, Unit B, Bozeman, MT 59718, the GRANTEE, as follows:
WITNESSETH
WHEREAS the Grantor is the legal record title holder of a public utility easement situated
along the south line of Lot 5, Block 7, Boulder Creek Subdivision, Phase 1, City of Bozeman,
Gallatin County, Montana.
WHEREAS the above public utility easement was granted by the filing of the plat of Boulder
Creek Subdivision,Phase i on August 23,2018 as Document Number 2624222,records of the office
of the Clerk and Recorder, Gallatin County, Montana.
WHEREAS the installation of utility infrastructure has been completed without having to
occupy the portion of said easement that lies along the south boundary of said Lot 5,Block 7,and the
vacation of the portion of the 10 foot wide public utility easement along the south line of said Lot 5,
Block 7 lying between the 10 foot wide utility easements along the east and west lines of said Lot 5,
Block 7, will not adversely impact the Grantor's interests.
WHEREFORE,the Grantor does hereby release and reconvey to Four Corners Construction,
LLC,the portion of the 10 foot wide public utility easement along the south line of said Lot 5,Block
7,lying between the 10 foot wide utility easements along the east and west lines of said Lot 5,Block
7,together with any right,title, or interest that the Grantor may have in said public utility easement.
The public utility easements located along the east and west lines of said Lot 5,Block 7,shall remain
intact.
