City of Bozeman, Gallatin County, Montana; and WHEREAS,the use is to be located on property that is legally zoned as B-2 (community business district) zoning district; and WHEREAS, the Special Use Permit(SUP) is contained within the City of Bozeman Department of Community Development's zoning application 19060; and WHEREAS, The Special Use Permit is required for the automobile repair in the B- 2zoning district and the Bozeman Municipal Code; and WHEREAS, the Special Use Permit application is subject to the following conditions of approval and code provisions: CONDITIONS OF APPROVAL 1. The applicant is advised that unmet code provisions, or code provisions that are not specifically listed as conditions of approval, does not, in any way, create a waiver or other relaxation of the lawful requirements of the Bozeman Municipal Code or state law. 2. Any expansion of this use or facility is not permitted unless reviewed and approved as required under the applicable regulations of the Bozeman Municipal Code. 3. Street improvements to Frontage Road including paving, curb/gutter, sidewalk, and storm drainage b. Street improvements to Springhill Road including paving, curb/gutter, sidewalk, and storm drainage c. Intersection improvements to Frontage Road and Springhill Road d. Intersection improvements to North 19th Avenue and Springhill Road The document filed must specify that in the event an SID is not utilized for the completion of these improvements, the developer agrees to participate in an alternate financing method for the completion of said improvements on a fair share, proportionate basis as determined by square footage of property, taxable valuation of the property, traffic contribution from the development, or a combination thereof. The applicant must provide a copy of the filed SID waiver prior to building permit approval. See attached email from Anna Russell,City of Bozeman Engineer. (�4. Street lights must be installed at the street intersectio4 of midd Spt!irlghill Read Initial a0 Reeves Road and Frontage Road and along Reeves at the standards spacing as required by the Bozeman Lighting and Electrical Specification in the City's Design Standards and Specification Policy subject to Montana Department of Transportation approval. Initial 5. The existing sign on site must be removed prior to building permit approval. 6. The sign easement release document must be recorded on the property prior to building permit approval. Conditional Use Permit and Special Use Permit Provisions Bozeman Municipal Code(BMC): 1) Section 38.230.110.F states that the right to a conditional use permit must be contingent upon the fulfillment of all general and special conditions imposed by the Conditional Use Permit procedure. All special conditions and code provisions must constitute restrictions running with the land, shall be binding upon the owner of the land,his successors or assigns,shall be consented to in writing by the applicant prior to commencement of the use and shall be recorded as such with the Gallatin County Clerk and Recorder's Office by the property owner prior to the final site plan approval or commencement of the use. All of the conditions and code provisions specifically stated under any conditional use listed in this title shall apply and be adhered to by the owner of the land, successor or assigns. 2) Section 38.230.110.I describes the process for termination/revocation of a Conditional Use Permit approval: a) Conditional use permits are approved based on an analysis of current local circumstances and regulatory requirements. Over time these things may change and the use may no longer be appropriate to a location. A conditional use permit will be considered as terminated and of no further effect if: i) After having been commenced,the approved use is not actively conducted on the site for a period of two continuous calendar years; ii) Final zoning approval to reuse the property for another principal or conditional use is granted; iii) The use or development of the site is not begun within the time limits of the final site LES SCHWAB TIRE STORE 19060 PAGE 2 OF 4 CONDITIONS OF APPROVAL FOR A SPECIAL USE PERMIT APPLICATION plan approval in Section 38.230.140 BMC. b) A conditional use which has terminated may be reestablished on a site by either,the review and approval of a new conditional use permit application, or a determination by the Planning Director that the local circumstances and regulatory requirements are essentially the same as at the time of the original approval. A denial of renewal by the Planning Director may not be appealed. If the Planning Director determines that the conditional use permit may be renewed on a site then any conditions of approval of the original conditional use permit are also renewed. c) If activity begins for which a conditional use permit has been given final approval,all activities must comply with any conditions of approval or code requirements. Should there be a failure to maintain compliance the City may revoke the approval through the procedures outlined in Section 38.200.160, BMC 3) BMC 38.360.070 Automotive repair facilities: a) All repairs or painting must be performed within a building; b) No site plan will be approved which exposes unassembled vehicles, auto repair activities or auto parts to any street or residential district; c) Any facility must be designed to contain and minimize noise and odors; d) All facilities must have a water quality facility (oil/water separator) as part of the water quality design for stormwater runoff, and must conform to section 38.410.080. 4) BMC 38.410.060.E Other easements.The release and reconveyance of the sign easement must be recorded prior to building permit approval. NOW,THEREFORE, BE IT HEREBY KNOWN,that the above-noted conditions of approval and code provisions for the Special Use Permit shall be binding upon the undersigned owner of the subject property, and successors or assigns, as long as the use remains at the property addressed at 1100 W. The reason for this street light is due to the anticipated pedestrian traffic for the shared use path,when it gets fully built out. The City will not require the one on Springhill because that pedestrian sidewalk is a standard sidewalk and not a lot of pedestrian traffic is anticipated. Please see their comment(below)regarding the 2 proposed street light location at Springhill and Reeves. They would like us to relocate this light out of MDT ROW as they don't find it necessary to light Springhill,however our photometric calculations likely would not support the luminance requirements per City of Bozeman design standards. Are we able to remove/relocate this proposed street light? Also,we will make adjustments to gas and telephone service locations to avoid encroachment onto MRL property. Please let me know how you'd like to proceed with the site plan review given these new comments from MDT. We would very much like to address these new MDT comments amidst your current review in order to avoid another resubmittal. I did a cursory look through the plans and have a couple of comments: * The street light you are proposing at the intersection of Springhill Rd. and Reeves Rd. is not required by MDT or necessary to light Springhill Rd. Please relocate it outside of MDT right-of-way. * It looks like you are proposing to install a gas service connection and telecommunications line within the Frontage Rd. R/W. If so,you must submit Utility Encroachment permits requesting permission to do that.You can contact Janet Black,Butte/Bozeman Utility Agent at(406) 494-9619, for more information. This Frontage Rd. right-of-way is actually owned by the railroad,with MDT easing on their property, so you must also contact Nick Bailey with MRL to obtain the necessary permit/authorization to place the service lines in the Frontage Rd. right-of-way. You can reach Nick at(406) 829-2409. We must see documentation that the railroad has approved the installation before we will approve it. Once all the appropriate MDT staff have reviewed the plans/information, I will forward any other comments to you. If you have any questions in the meantime,please let me know.
