Hestated his concerns about the unfairness of the rates. He also commentedon his understanding of the Federal and Tax lncrement Financing dollarsused for the Parking Garage.Ashley Ogle, 5 E Lamme St.; Commented from an operations standpointand the diffìculty to run a business when parking is so unpredictable andpermit rates continue to increase with very little notice. She would like theability to negotiate.Cory Lawrence, 4510 Morning Sun Drive; Commented on the Etha Hotelproject and the continued efforts going forward. He offered to take theCommission through the property. Mr. Lawrence commented on permitpricing elasticity, and the UDC parking lease requirements. He distributeda document showing current lease costs and his projected garageoccupancy calculations.E. Ex Parte Disclosures of Parkinq CommissionersF. Action ltems1. Annual City of Bozeman Ethi Training for Boards & Committees.Mr. Meece conducted the 2019 annually required ethics training for theBozeman Parking Commission.2. Discuss/Approve/Deny Bozeman Parking Commission Resolution 2019-1O A RESOLUTION OF THE BOZEMAN PARKING COMMISSION OFTHE CITY OF BOZEMAN, MONTANA, APPROVING THE SEGONDAMENDMENT (#2) OF AN "AGREEMENT FOR THE USE OF PARKINGSPACES IN THE BRIDGER DOWNTOWN INTERMODAL FACILITY''EXTENDING THE DEADLINE FOR ISSUANCE OF A FINALOCCUPANCY PERMIT TO APRIL l, 2O2O; AND AUTHORIZING THEPARKTNG PROGRAM MANAGER TO S|GN THE AMENDMENT (#21.Mr. Meece explained the agenda item and the original agreement with theEtha project. Exhibit 1: Bozeman Parking Commission, L/9/2O2OCommissioner Egge asked for clarification on the 100 spaces in thebasement of the Parking Garage. Mr. Meece pointed out that the basementparking is considered premium parking, and originally was considered forvalet hotel use. He also pointed out that there are no restrictions on the waywe manage the basement. Commissioner Egge clarified that there are nolimits to overselling the basement parking spots. Mr. Meece confirmed thatwas correct.Commissioner Neubauer asked about the UDC requirements, and when theactual lease for 25 years begins.Tom Rogers, Community Development Department; Explains how the UDCrequirements work today and that currently the UDC lease agreementsbegin at site plan approval. He also commented on how the Etha fell undera previous site plan approval process and has a unique agreement.Commissioner Wiseman stated that the UDC lease agreement should startat occupancy.Laurae Clark stated that the Etha is currently paying for 54 spaces in themain garage, and has been since June of 2016.Cory Lawrence, 24 Mendenhall; Clarified several points of discussion.He pointed out that the basement parking was originally a hotel incentive,and premium non-public parking. Discuss/Approve/Deny Resolution 2019-021 A RESOLUT¡ON OF THEBOZEMAN PARKING COMMISSION OF THE CITY OF BOZEMAN,MONTANA, INCREASING THE COST OF PARKING PERMITS ANDLEASES AT THE BRIDGER PARK DOWNTOWN GARAGE AND BLACK,ROUS, N. WILLSON, AND S. WILLSON SURFACE LOTS. (Exhibit 3)Mr. Meece explained the resolution regarding increases to garage parkingpermits, and the rate structure. He discussed the current market rate ofparking, and the cost of building new parking. He also described theproposed day and evening rates for parking in the parking garage.Mr. Meece clarified the point that the federal money received by the city wasfrom the Federal Transit Administration (FTA), and it was for incentivizing apublic transit facility not to boost downtown development. He also clarifiedthat no organization was forced into the UDC lease agreements. They hadother options to meet their parking requirements.Commissioner Winston asked about the Cash in Lieu option to meet parkingrequirements.Commissioner Neubauer asked about the federal debt pay back and howthat looks.Mr. Meece stated that we have compiled a report of our programrevenue/expenses in the parking garage, at the request of the F . He alsodescribed the need to stabilize and increase the reserve funds needed foron-going capital maintenance pr ects in the garage.Commissioner Egge asked if we are proposing a transient rate change also.Mr. Meece clarified that it is not actually changing the rates but creating moreoptional day/evening rates for payment of parking in the garage.Chair Ness stated that the price increase reflects the demand for downtownparking.Commissioner Wiseman suggested that the changes should have beenreviewed earlier in the year, and possibly staged in more palatableincrements.Chair Ness stated that he is sensitive to the UDC lease holders and thinksthat the monthly lease holder should have some incentive over transient1 Resolution 2Ot9-O2 was not used earl¡er ¡n the calendar year, by administrative error. For cons¡stency, the C¡ty Clerk asked ¡t be used for thislegislation. Exhibit 1: Bozeman Parking Commission , L/9/2O2Ousers. He also does not want to see park¡ng being pushed out ¡ntoresidential districts.David Fine stated that UDC lease holders can change their park¡ng opt¡onsto meet their requirements.Commissioner Neubauer indicated that the rate increase may incentivizepeople to enter into other agreements to meet their parking requirements.Mr. Meece suggested that the UDC parking code also needs to be reviewedand updated.Commissioner Egge clarified that about half the leases in the garage areheld by individuals (non-UDC). He made a motion to change the rates asstated on the resolution from $70 to $80 in the main garage, $80 to $100 inthe basement, $50 to $60 on the surface lots and to add a $5 day use and$3 evening use rate in the garage.Commissioner Winston o red an amendment to the proposal of changingthe basement, rate to $92 to have a consistent percentage rate increase.Commissioner Neubauer stated that the rates in the basement should bemuch higher as they are premium parking spots.Commissioner Wiseman stated that the rates should be revisited in thesummer of 2020, to allow more time for consideration by all parties.Chair Ness reiterated that the rates for 2O20 are as follows each Hour $1;day use 6am to 6pm $5; night use Spm to 8am $3; 24 hour max $9. MonthlyGeneral & UDC permits $80; Monthly Basement & UDC permits $92; andsurface lots $60.David Fine stated the importance of the demonstrated demand andunderstanding our market to make effective decisions for the price ofpermits.The rates were approved as stated by Chair NessCommittee Member - Mark Eege: MotionCommittee Member - Exhibit 1: Bozeman Parking Commission , U9/2O2OStaff - Ed Meece: N\AH.Parkinq Proqramnaqer Report(Exhibit 4)Commissioner Wiseman asked about data counts in the vicinity of theBlacUOlive housing project.Commissioner Neubauer asked about revisiting the lease rates earlier in theyear.David Fine stated that UDC rates can only be adjusted once a year per thelease agreement.Commissioner Neubauer strongly stated his feelings that the ARB meetingsshould be scheduled later in order to make sure there is enough time to workthrough the Parking Commission Agenda.l.
