Sundance Minor Subdivision Final PlatCommission Memorandum REPORT TO: Honorable Mayor and City Commission FROM: Tim Cooper, Assistant City Attorney Tom Rogers, Senior Planner SUBJECT: Approve the Final Plat for the Sundance Minor Subdivision Final Plat; authorize the Director of Public Works to execute the same on behalf of the City of Bozeman, and the Director of Community Development to execute the improvements agreements on behalf of the City of Bozeman, Application 19307. MEETING DATE: January 6, 2020 AGENDA ITEM TYPE: Consent RECOMMENDATION: That the City Commission approve the Final Plat for the Sundance Minor Subdivision Final Plat; and authorize the Director of Public Works to execute the same on behalf of the City of Bozeman, and the Director of Community Development to execute the improvements agreements on behalf of the City of Bozeman. STRATEGIC PLAN: Vision Statement: 4. A Well-Planned City. Continue to support high quality planning, ranging from building design to neighborhood layouts, while pursuing urban approaches to issues such as multimodal transportation, infill, density, connected trails and parks, and walkable neighborhoods. 4.4 Vibrant Downtown, Districts & Centers. Promote a healthy, vibrant Downtown, Midtown, and other commercial districts and neighborhood centers – including higher densities and intensification of use in these key areas. BACKGROUND: On March 23, 2015, the City Commission approved the findings of fact completing the preliminary plat approval to subdivide 27.855 acres together with the required supplementary plans and information to create three commercial lots and a park, and rights-of- way. The developer has applied for final plat review and approval. The preliminary plat was unanimously approved (5:0) by the City Commission on March 2, 2015. Staff has concluded that all terms and conditions of the preliminary plat approval have been met. An improvements agreement has been completed for the future installation of landscaping, Davis Lane improvements, pedestrian corridor, and boulevard landscaping improvements. The appropriate financial guarantees have been received. 9 §76-3-611(1), MCA, provides that the City Commission shall approve the plat only if: (a) it conforms to the conditions of approval set forth on the preliminary plat and to the terms of this chapter and regulations adopted pursuant to this chapter; and (b) the county treasurer has certified that all real property taxes and special assessments assessed and levied on the land to be subdivided have been paid. Attached is a memorandum from Tom Rogers, Senior Planner, stating the staff has concluded that all terms and conditions of the preliminary plat approval have been met. An Improvements Agreement is required for final plat approval of this subdivision. The improvements agreement guarantees the installation of public street lighting, park improvements, lot frontage sidewalks, and subdivision pathways. All other necessary infrastructure improvements are constructed. UNRESOLVED ISSUES: None. ALTERNATIVES: As proposed by the City Commission. FISCAL EFFECTS: Fiscal impacts are undetermined at this time, but will include increased property tax revenues from new development, along with increased costs to deliver municipal services to the property. Report compiled on December 26, 2019 Attachments: Staff Memo Final Plat 10 MEMORANDUM ---------------------------------------------------------------------------------------------------------- TO: GREG SULLIVAN, CITY ATTORNEY ROBIN CROUGH, CITY CLERK FROM: TOM ROGERS, SENIOR PLANNER RE: FINAL PLAT REVIEW FOR THE SUNDANCE MINOR SUBDIVISION, PHASE A & C, PLANNING FILE NO. 19307 DATE: December 11, 2019 ---------------------------------------------------------------------------------------------------------- Baxter Meadows Land Partners, LLC (Applicant), made application to the City of Bozeman Department of Community Development for Final Plat review and approval for the Sundance Minor Subdivision, Phase A and C to create three (3) lots, dedicate a park, dedicate street rights-of-way, and provide public access easements. Attached is a copy of the Findings of Fact and Order. The Commission unanimously approved the Findings of Fact on March 23, 2015. Minor subdivision approvals are valid for one year. However, due to a clerical error the Sundance Minor subdivision was granted a three year approval. In addition, four extensions were granted extending the preliminary plat approval to January 22, 2020. An Improvements Agreement is required for this subdivision for the following improvements: lot frontage sidewalks, subdivision street improvements, street frontage landscaping, park improvements, and recreation pathway improvements. Based on the summary review provided below, the City Engineering Department and Department of Community Development have reviewed the application against the conditions of preliminary plat approval; and as a result, find that the Final Plat application may be approved by the City Commission. Three (3) original mylars of the Final Plat, original Platting Certificate, property owner association documents, improvements agreement, and a copy of the Findings of Fact and Order are attached for your review. The Community Development staff respectfully requests that you prepare City Attorney's Certificates using the attached original Platting Certificates as updated; approve the Certificates of Director of Public Works and Certificate of Completion "as to form". The final City signatures will be obtained once the City Commission has approved the final plats. A completed application was submitted to the Community Development Department on December 3, 2019, upon receipt of an acceptable letter of credit for financially guarantee uninstalled subdivision improvements. 11 Page 2 of 2 Provisional completeness is granted subject to a revised Platting Certificate and a financial guarantee for landscape improvements. The 20-day (working days) review period for this final plat will initiate once the aforementioned items are received. The conditions of preliminary plat approval, which are pertinent to this minor subdivision and how they have been met, are described in the submittal materials. Note: The Community Development Department and Engineering Department have also reviewed the final plat application against the preliminary plat cited code provisions and found compliance with these code requirements. The Engineering Department has also reviewed and approved the “closure” of the final plat. The project is scheduled for consideration by the City Commission on December 23, 2019. Please let me know if this will not work.
