SUBJECT: Approval of professional services agreement amendment two; to extend time but
not cost with LoganSimpson for professional services in support of the growth
policy and authorization for the City Manager to sign the agreement on behalf of the City.

RECOMMENDATION: That the City Commission approve the professional services agreement
amendment with Logan Simpson and authorize the City Manager to sign the agreement on behalf of the
City.
BACKGROUND: The City Commission funded an update to the city’s growth policy, the Bozeman
Community Plan, in the 2018 and 2019 Fiscal Years. After completion of a solicitation and review of a
request for proposals Logan Simpson was selected. The initial professional services agreement was
approved by the City Commission on May 21, 2018.
In fiscal year FY 2019/20, an additional $50,000 was allocated by the City Commission for the Growth
Policy update project. A standard professional services agreement was executed by the contractor. The

This amendment extends the allowed work period to complete the project. This amendment does not change authorized cost.
UNRESOLVED ISSUES: None determined at this time.

SECOND AMENDMENT TO PROFESSIONAL SERVICES AGREEMENT
THIS SECOND AMENDMENT TO THE PROFESSIONAL SERVICES AGREEMENT
FOR professional services for updating the 2009 Bozeman Community Plan dated May 21st, 2018
(the “Agreement”) is made and entered into this _____ day of ____________, 2019, by and
between the CITY OF BOZEMAN, MONTANA, a self-governing municipal corporation
organized and existing under its Charter and the laws of the State of Montana, 121 North Rouse
Street, Bozeman, Montana, with a mailing address of PO Box 1230, Bozeman, MT 59771,
hereinafter referred to as “City,” and Logan Simpson Design Inc. dba LoganSimpson, 213 Linden
Street, Suite 300, Fort Collins CO 80524 hereinafter referred to as “Contractor.”
In consideration of the mutual covenants and agreements herein contained, the receipt and
sufficiency whereof being hereby acknowledged, the parties hereto agree to amend the Agreement
as follows:
1. Extension of Term. Section 2 of the Agreement is extended for an additional six (6) month
period. The Agreement shall terminate on June 30, 2020. Per Section 30 of the agreement
additional extensions may be approved not to exceed August 1, 2020.
2. Agreement still valid. All remaining terms and provisions of the Agreement remain valid.
