Changes to the Agenda No changes to the agenda, however three items of correspondence were submitted after the agenda was published. There was a September 10th letter from Jon Kaufmann and Brian Gallik; a September 11th letter from Alan McCormick; and a September 12th email from Darrell Cherry on behalf of Steve Roderick. C. Approval of minutes for August 11, 2019 (Exhibit 1) Commissioner Wiseman pointed out that in the August minutes he was marked as approving the motion for data collection in the High School parking permit district but was actually absent from the meeting. Public Comment – Members of the audience or their agent may be invited to present testimony or evidence. To be recognized, each person desiring to give testimony or evidence shall step forward and, after being recognized, give their name and address for the record. The presiding officer may establish a time frame for each public comment but in no case shall such timeframe be less than three (3) minutes per speaker. The presiding officer may lengthen or shorten the time allotted for public testimony. None E. Ex Parte Disclosures of Parking Commissioners None F. Action Items 1. Discuss/Approve/Deny Bozeman Parking Commission Resolution 2019-06 PARKING BENEFIT DISTRICT OUTLINE (Exhibit 2) Mr. Meece introduced the item and explained the public engagement and the process that has taken place so far on this topic. Commissioner Neubauer asked how the residential parking districts currently work and asked how future districts permits would be allotted out. Mr. Meece explained how the public feedback seemed to express a desire for a more restrictive policy to selling permits. Commissioner Lloyd asked about data collection, and the status going forward with the creation of these districts. He also pointed out the importance of the 85% standard when considering these districts. Mr. Meece commented on T2, and its data collection capability and also the technology. He has confidence that it should be able to provide valuable data once all of its potential is unleashed. David Fine commented on the importance of using data for decisions on this topic and also suggested managing to a somewhat larger boundary in order to avoid conflict. 07:41:56 AM (00:11:34) Kathy Powell, 1215 S 3rd Ave; Commented on the future notification of parking districts creation and change. She talked about the parking permit districts and pointed out the language and wording that she would like to see clarified. 07:44:50 AM (00:14:28) Corinne Selby, 709 S 6th Ave; Wanted to comment on the number of permits allowed to be purchased in a residential district. She commented on making residents pay to park in front of their own homes and she questioned data collection benefiting the residential parking districts. Mr. Meece clarified the distribution of visitor permits within the district. He pointed out that it is in the code that the district must pay for itself. He commented on bullet point number two and pointed out that this is what we started with and bullet point number three is what it has evolved to. 07:51:39 AM (00:21:17) Commissioner Lloyd clarified that there are two separate items being discussed. The first is the parking permit district and the second is new parking benefits districts. Commissioner Neubauer pointed out that he would like to tidy up the language and wording. 07:54:21 AM (00:23:59) Mr. Meece suggested a motion to amend the outline to read “that each licensed driver in the district may purchase up to one residential permit, and each residence may purchase two visitor permits for use in the district, trailers, campers and other items are not eligible for permits in the district.” Commissioner Neubauer made a motion to amend the document as outlined by Mr. Meece. Commissioner Wiseman motioned to approve the resolution as amended. Commissioner Egge pointed out that this is a recommendation for the framework to be sent to the City Commission to be approved. Mr. Meece pointed out that it would be nice to have members of the Parking Commission present when this topic is being presented to the City Commission. 2. Discuss/Approve/Deny Bozeman Parking Commission Resolution 2019-05 A RESOLUTION OF THE BOZEMAN PARKING COMMISSION OF THE CITY OF BOZEMAN, MONTANA, ADOPTING REVISIONS TO THE EXISTING “PARKING LEASE POLICY” (BPC RESOLUTION 2017-04), RE-TITLED AS THE “PARKING PERMIT POLICY’, FOR THE PURPOSE OF ADMINISTERING THE PUBLIC PARKING PERMIT PROGRAMS OPERATED BY THE BOZEMAN PARKING COMMISSION AT THE BRIDGER DOWNTOWN PARKING GARAGE, AS WELL AS THE BLACK, ROUSE, AND N. WILLSON PUBLIC PARKING LOTS. (Exhibit 3) 08:04:23 AM (00:34:01) Mr. Meece introduced the topic and explained the policy. He walked through the document and pointed out the difference between long term leases and permits. Mr. Meece discussed the importance of annually reviewing the City Document. He stated that there will be no bulk sales of garage permits and noted that modification of this policy is much needed. Commissioner Egge questioned the change between lease and permit. He also questioned the use of the lease policy to fulfill Community Development UDC requirements. 08:14:34 AM (00:44:12) Cory Lawrence, 4510 Morning Sun Drive; thanked the Parking Commission for their continued evolution of managing parking. He discussed the clarification of permits vs leases and addressed the 85% rule. He noted the change of supply and demand and the correlation with pricing. 08:14:34 AM (00:44:12) Ashley Ogle, 5 East Lamme; stated her appreciation to the Parking Commission for addressing the parking issues downtown. She also questions the UDC data and its accuracy and also the formula being used for the Parking Permit Calculator. 08:19:41 AM (00:49:19) Andy Holloran, 20 N Tracy; stated he is here to oppose the proposed resolution of the document. He questioned why the modifications were being made and what data is supporting the change. He feels that the Parking Garage is an underutilized public asset. 08:21:11 AM (00:50:49) David Loseff, 105 W Main; commented on his strong support of the resolution. He pointed out the rapid growth that continues throughout the downtown and also the new hotel opening soon. He agrees with managing the public Parking Garage with flexibility for the future. 08:23:36 AM (00:53:14) Jon Kauffman, 716 S 20th Ave; followed up on the letter he submitted and pointed out that this agenda item represents exactly why commissions such as the Parking Commission are formed and utilized. He commented on the forward thinking and flexibility in the policy being considered. 08:24:23 AM (00:54:01) Corinne Selby, 709 S 6th Ave; commented on her support of the change and having flexibility. She also stated she would like to see winter data for the Parking Garage. 08:25:51 AM (00:55:29) Allen McCollum, 1849 E Cameron Bridge Road. He thanked the Parking Commission and supports their work on this resolution. He encourages the commission to continue to do what is right for everyone in Bozeman and not just one individual. 08:26:57 AM (00:56:35) Mr. Meece clarified that the City of Bozeman does not desire to revoke parking permits. He pointed out that the permits produce revenue and we must be fiscally responsible. He also stated that we know the current number of UDC long term leases and can track them. He also commented on the data collection in the garage and the use of the average peak occupancy. Mr. Fine pointed out the concept of supply and demand and the current pricing of a parking spot in the garage. 08:31:44 AM (01:01:22) Commissioner Lloyd asked about the question of revoking permits and if it would be last in first out. He also questioned the number of 76% of peak occupancy and if it is a reliable number. He also pointed out that the role of the garage was initially a catapult for economic development. He also questions if this policy would limit future development. 08:33:27 AM (01:03:05) Commissioner Wiseman pointed out the contradictory data that is being discussed. He also stated that we do not know the impact of the new hotel coming to downtown. He commented that the garage served its original purpose to attract commercial growth downtown. He also commented that at this point the impact of the growth and development must now be managed and agrees with keeping flexibility in the Parking Garage. Commissioner Neubauer commented on his concern of the impact that creating districts downtown will have, and about the constant evolution of the lease limit calculator. Commissioner Egge stated that the Parking Commission does not issue long term leases. It is ultimately the City Commissions decision. He also pointed out that parking is not a finite resource but that money is, and we should consider that when discussing growth and development downtown. 08:44:10 AM (01:13:48) Commissioner Lloyd stated that the way we move around is going to evolve in the future. He is concerned about the elimination of UDC leases and would like to be able to revisit this policy in the future. Review Parking Permit Calculator (Exhibit 4) Mr. Meece explains the change in the format of the data but pointed out that it is the same data. He explains the numbers and how the calculator is analyzed. He pointed out that we are managing to an average of peak occupancy. Commissioner Neubauer would like to see the annual and monthly permits separated out in order to see the room for movement. 08:56:01 AM (01:25:39) Mr. Fine agrees with Commissioner Neubauer and pointed out that the total stalls available should be shown. 08:58:00 AM (01:27:38) Chris Naumann, Downtown Business Association; commented on the lease calculator and its reliable accountability. He also noted the parking inventory downtown and the time spent on the discussion and the policy management of one resource. 09:00:39 AM (01:30:17) Commission Wiseman commented that the reason why we spend extra time with the management of the Bridger Park Garage is because it is paid parking and also an investment tool. He also commented on the ability to change and evolve the document as needed. Commissioner Egge asked about the low utilization rate of the leases we do have. He also questions the pricing of the lease. Mr. Meece explained that the price point should reflect when the waitlist is zero. 09:08:29 AM (01:38:07) Mr. Meece commented on the pricing of transit parking and the effect it may have on occupancy. Parking Program Manager Report (Exhibit 5) (Exhibit 5A: Occupancy Report) Mr. Meece pointed out that a request has been made for new UDC leases under the unreformed policy and those will eventually be sent to the City Commission for further action. Mr. Meece mentioned that the mailed parking citations enforcement has been implemented for the Bridger Parking Garage. He stated that an amended agreement for the use of the Armory Parking Lot is being drafted. Mr. Meece pointed out the healthy operating reserves in the parking budget and commends the Parking Commission. Commission Neubauer asked about the overtime citation violations and the mailed out citations. He also asked about the Parking Program Managers Strategic plan number 25 regarding the Carnegie Lot. Mr. Meece explained that the Strategic plan is followed somewhat in order and number 25 has not been discussed much yet. Commissioner Neubauer also asked about resent activity on number 8, re-evaluate and clarify the purpose and intent of the current code section regarding special improvement districts. Commissioner Lloyd asked about overtime citation and if there is an ability to add time. I. New Business None J. Adjournment. Upcoming Items (Tentative): October 2019: Discuss Parking Services Divisions’ 2019/2020 annual budget performance measures. Consider/Approve/Deny extension of License Agreement for Etha Hotel (use of Armory Parking Lot). Presentation from Downtown Business Partnership regarding proposed parking code amendments in Downtown Plan. * “Montana Parking Summit 2019”: The City of Bozeman has developed a partnership with the cities of Missoula, Helena, Billings, and Great Falls to conduct a ½ day training and educational opportunity for municipal parking operations in Montana. ‘MPS 2019’ will be held in conjunction with the Montana League of Cities 2019 Conference, October 2, 8:30 AM, Billings Hotel & Conference Center, Billings, Montana. Further information regarding the MPS 2019 agenda, and other details, will be provided as they are available. November 2019: Annual Board Ethics Training (required by Bozeman City Charter) The next Bozeman Parking Commission meeting will be held October 10, 2019, 7:30 am, at City Hall.
