SUBJECT: Resolution 5116 authorizing Change Order No. 1 to the Pear Street Booster
Station Rehabilitation Project.

RECOMMENDATION: Approve Resolution 5116 authorizing Change Order No. 1 to the Pear Street Booster Station Rehabilitation Project.
BACKGROUND: Attached is a copy of resolution 5116 and change order number 1 for the
above referenced project. When drilling holes into the existing floor slab to epoxy in rebar for
attaching the new equipment pads for the pumps, on the contractor discovered that the existing
floor was much thinner in areas than anticipated, and also that there were voids under the slab. It was determined that the best course of action was to cut out the floor where the pads go and pour new foundations to properly support the weight that will be placed on them. This change order
covers that cost of the new foundations. The change also includes an addition of 7 days to the
contract time. The final recommended change in cost and time for these items is reasonable and
commensurate with the work involved.
UNRESOLVED ISSUES: None
ALTERNATIVES: As suggested by the City Commission.
FISCAL EFFECTS: This change order increases the contract amount by $11,637.52 from
$521,060.00 to $532,697.52.

RESOLUTION NO. 5116
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN,
MONTANA, APPROVING ALTERATION/MODIFICATION OF CONTRACT WITH
WESTERN MUNICIPAL CONSTRUCTION, INC., BILLINGS, MONTANA.
WHEREAS, the City Commission did, on the 11th day of April 2019, authorize award of
the bid for the Bozeman Pear Street Booster Station Rehabilitation project, to Western Municipal
Construction Inc., Billings, Montana; and
WHEREAS, Section 7-5-4308, Montana Code Annotated, provides that any such
alterations or modifications of the specifications and/or plans of the contract be made by resolution;
and
WHEREAS, it has become necessary in the prosecution of the work to make alterations or
modifications to the specifications and/or plans of the contract.
NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of
Bozeman, Montana, that the proposed modifications and/or alterations to the contract between the
City of Bozeman, a municipal corporation, and Western Municipal Construction Inc., as contained in
Change Order No. G-1, attached hereto, be and the same are hereby approved; and the City Manager
is hereby authorized and directed to execute the contract change order for and on behalf of the City;
and the City Clerk is authorized and directed to attest such signature.
