SUBJECT: Commission Resolution No. 5111 – Establishing fees for the issuance of
retail beer, wine, and liquor licenses
MEETING DATE: November 18, 2019

RECOMMENDATION: Approve Resolution No. 5111 – Establishing fees for the issuance
of retail beer, wine, and liquor licenses.
BACKGROUND:
Sec. 4.02.060 of the City code states “The city commission will, on an annual basis, set the fee
for alcohol licenses as well as special permits by resolution.” This resolution is setting the annual
fee and there are no changes to the fees for this upcoming year.
ALTERNATIVES: As suggested by the Commission
FISCAL EFFECTS: This is just stating the rates for the licenses for the upcoming year and
there are no changes to the fees. Revenue estimation for this fee collection will remain the same
as the adopted budget.

RESOLUTION NO. 5111
A RESOLUTION OF THE CITY COMMISION OF THE CITY OF BOZEMAN,
MONTANA, ESTABLISHING FEES FOR THE ISSUANCE OF RETAIL BEER, WINE
AND LIQUOR LICENSES BY THE CITY OF BOZEMAN.
WHEREAS, the City of Bozeman is authorized to collect fees for services provided based
on the provisions of Section 7-6-4013, MCA following notice and a public hearing; and
WHEREAS, Section 16-4-503, MCA authorizes the City of Bozeman to issue licenses to
persons to whom a retail license has been issued by the State and to fix license fees for the
issuance of such City licenses; and
WHEREAS, the City has adopted regulations requiring a City license for the
manufacture or sale of alcohol in the City under the provisions of the Montana Alcoholic
Beverage Code; and
WHEREAS, Section 4.02.030, Bozeman Municipal Code, authorizes fees for the
issuance of City licenses for the retail sales of beer, wine, and spirits; and
WHEREAS, the City of Bozeman, following notice and public hearing establishes the
following license fees.
NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of
Bozeman, Montana:
Section 1
The City Commission hereby adopts the following fee schedule for retail licenses for the
sale of beer, wine, and spirits issued by the City of Bozeman:

Effective
Beer & Wine: January 1, 2020
Retail Sale of Beer & Wine $400.00
Retail Sale of Beer Only $200.00
Retail Sale of Wine Only $200.00
Liquor:
Retail Sale of Liquor $500.00
Catering Alcohol* - per event $35.00
*Requires State License endorsement and applicable City of Bozeman Beer/Wine/Liquor
licenses.
Section 2
This fee schedule shall be in full force and effect on January 1, 2020.

PASSED, ADOPTED, AND APPROVED by the City Commission of the City of
Bozeman, Montana, at a regular session thereof held on the 18th day of November, 2019. This
Resolution shall be effective on January 1, 2020.
