STORM DRAINAGE EASEMENT
James P. Tarpey and Glenn E. Ostrowski, GRANTORS, in consideration of One Dollar
($1) and other good and valuable consideration, receipt of which is acknowledged, grant to the
City of Bozeman, a municipal corporation of the State of Montana, with offices at 411 East Main,
_P.O. Box 1230, Bozeman, MT 59771.1230, GRANTEE, its successors and assigns, an
easement for pUblic storm drainage purposes, in, through and across the following described
real property situated in Gallatin County, Montana, more particularly described as follows:
Tract A-1-A of the Amended Plat of Tract A-1 of the Amended Plat of Tract 'A' of C,O.S. 27 A &
Lot 1 of the Amended Subdivision Plat, Rearrangement of Block 1, Bridger Center Subdivision,
& Lot 1A-1 of Bridger Center Subdivision, Amended Lot 1A & 1 B, situated in the W1/2 SW1/4
SE1/4 Section 31, T1 S, R6E, P.M.M" City of Bozeman, Gallatin County, Montana.
Said easement being a 15-foot wide and 40-foot wide strip as depicted on attached Exhibit A.
The GRANTORS warrant that they are lawfully seized and possessed of the real
property described above, that they have and that they will forever defend the title of this
property against the claims of all persons.
The GRANTORS further agree that the GRANTEE may peaceably hold and enJoy the
rights and privileges herein granted without any interruption by the GRANTORS.
The terms, covenants and provisions of this easement shall extend to and be binding
upon the heirs, executors, administrators, personal representatives, successors and assigns of
the parties hereto.
