TRAIL CORRIDOR EASEMENT
This Easement agreement, made this ~ day of 5vV\ e ,2006, by and between
James P. Tarpey and Glenn E. Ostrowski, hereinafter called "Grantors" and the City of
Bozeman, a municipal corporation, hereinafter called "City".
NOW, THEREFORE, the Grantors do hereby _grant and convey unto the City and its
assigns an irrevocable and perpetual trail corridor access easement for the use of the public in,
to, over and upon a strip of land (see attached Exhibit A) situated in Gallatin County, Montana,
which is located on the following described real property:
Tract A-1-A of the Amended Plat of Tract A-1 of the Amended Plat of Tract 'A' of C.O.S. 27 A &
Lot 1 of the Amended Subdivision Plat, Rearrangement of Block 1, Bridger Center Subdivision,
& Lot 1 A-1 of Bridger Center Subdivision, Amended Lot 1 A & 1 B, situated on the following
described real property:
The W1/2 SW1/4 SE1/4 Section 31, T1 S, R6E, P.M.M., City of Bozeman, Gallatin County,
Montana.
The GRANTORS warrant that they are lawfully seized and possessed of the real
property described above, that they have and that they will forever defend the title of this
property against the claims of all persons.
The GRANTORS further agree that the GRANTEE may peaceably hold and enjoy the
rights and privileges herein granted without any interruption by the GRANTORS.
The terms, covenants and provisions of this easement shall extend to and be binding
upon the heirs, executors, administrators, personal representatives, successors and assigns of
the parties hereto.
