OAK STREET AGREEMENT
THIS AGREEMENT is made as of May
17

, 1999, by and between:
THE CITY OF BOZEMAN, 411 East Main, P.o. Box 640,
Bozeman, Montana 59771 (Phone: 406-582-2320), and
GALLATIN COUNTY, 311 West Main, Room 301, Bozeman,
Montana 59715 (Phone: 406-582-3000).

RECITALS
WHEREAS, the CITY and COUNTY agree that the Oak Street
Project (Project), a portion of which is shown on attached Exhibit
A, will be of mutual benefit to both the COUNTY and the CITY; and
WHEREAS, the COUNTY has real property at the Gallatin County
Fairgrounds which is required by the CITY for right-of-way for the
Oak Street project; and
WHEREAS, the CITY needs to obtain an easement from the COUNTY
on behalf of the Montana Power Company for relocating electric
facilities that conflict with the Project; and
WHEREAS, the COUNTY desires certain improvements, guarantees,
and other considerations for its real property; and

WHEREAS, it is the intent and purpose of both the COUNTY and
the CITY to enter into this Agreement which will allow for the
full and satisfactory completion of the Project;
NOW, THEREFORE, in consideration of the mutual covenants and
conditions contained herein, it is agreed as follows:
1. County to Deed Property to the City. After receiving the
Money Compensation referenced in paragraph 6, the COUNTY shall
give the CITY a Quitclaim Deed for Tract A of the Amended Plat to
the Imes Addition to Bozeman, Blocks 2, 3 & 4, a copy of which is
attached as Exhibit B.

3. city to Construct Road Approaches. The CITY shall allow
for five road approaches for accesses from the COUNTY property to
the Oak Street Project. Three of the approaches shall be built by
the CITY and located at approximately Stations 25+25 RT; 27+10 RT;
and 32+00 RT as shown on sheets 17, 18, and 19 attached as
Exhibits D, E, and F. The CITY must complete construction of
these road accesses no later than the completion of the Proj ect
and the opening of Oak Street to vehicle traffic.

The CITY shall allow for two future road approaches to be
constructed by the COUNTY at approximately Stations 40+00 RT; and
between 44+50 to 45+00 RT for a utility access.
4. City To Construct Chain Link Fence. The CITY shall
construct a standard eight foot high chain link fence along the
Fairgrounds, from approximately station 40+00 RT to Station 45+20
RT as referenced on Exhibits E and F, which will match the
Fairgrounds fence along Tamarack Street. The chain link fence
must be completed no later than the opening of Oak Street to
vehicle traffic.

6. Money Compensation to the County. The CITY shall pay the
COUNTY $25,913.23. The basis for calculating the amount 0 f money
compensation is the County's engineering and construction costs
for approximately 419 feet of 10" sewer pipe and 3 manholes
located in the future alignment of North Third Avenue. This
amount must be paid before the County deeds the property to the
City under paragraph 1 of this Agreement. The COUNTY acknowledges
that this shall constitute the total monetary compensation from
the CITY under this Agreement, and upon payment of the amount
stated shall release the CITY from obligation for any further
compensation.
7. Subdivision exemption. Both the CITY and COUNTY shall
seek appropriate subdivision review exemptions for conveying the
real property under this Agreement.
S. Integration. This document represents the entire
integrated Agreement between the CITY and COUNTY, and supersedes
all prior negotiations, agreements or representations, either
written or oral. This Agreement may be amended only in writing
signed by both CITY and COUNTY.
IN WITNESS WHEREOF the City of Bozeman and Gallatin County
have signed this Agreement consisting of four (4) pages, including
the signature pages, together with attached Exhibits A through F.

WITNESSETH: GALLATIN COUNTY in consideration of $25,913.23,
and other valuable consideration, receipt of which is
acknowledged, does hereby convey, remise, release and forever
quitclaim to the City of Bozeman, and to its successors and
ass~gns, all right, title and interest in and to the following
described real property in Gallatin County, Montana:
As described in Exhibits A and B attached hereto and
made a part of this Quitclaim Deed by reference.
Together with all the tenements, hereditaments, and appur-
tenances thereto belonging or in anywise appertaining to the City
of Bozeman, its successors and assigns forever.
The purpose of this Quitclaim Deed is to provide a right-of-
way for the city of Bozeman to construct a portion of Oak Street.
IN WITNESS WHEREOF, GALLATIN COUNTY has signed this Quitclaim
Deed by its Board of County Commissioners the day and year first
