Commission Memorandum
REPORT TO: Honorable Mayor and City Commission

SUBJECT: Contract for a Commissioning Services for the Pre-construction and
Construction Phases for the Bozeman Public Safety Center (BPSC).
MEETING DATE: October 14, 2019
AGENDA ITEM TYPE: Consent
RECOMMENDATION: Authorize the City Manager to sign contracts between City of
Bozeman and Elkhorn Commission Group for Commissioning Services for the pre-construction
and the option to amend the contract to include construction phases of the BPSC.
BACKGROUND: On August 5, 2019, the City Commission approved a contract with Langlas
and Associates for general contractor/construction manager services for the BPSC. Langlas joined
Thinkone Architects on the City’s project team and now with the hiring of a commissioning agent,
the City’s project team will be complete. In short, commissioning services are used to ensure that the mechanical, electrical, and building systems for the BPSC are specified, installed and operating
properly and in a highly efficient manner. The commissioning agent will also work with the City
to analyze the long-term operating costs of these systems to ensure efficiencies well into the
building’s operational life span.
Through the qualifications-based selection process the City chose Elkhorn Commissioning Group
as the finalist and entered into contract negotiations. The result of those negotiations is the contract
attached to this memorandum. A full list of services provided by the commissioning agent is
included in the agreement beginning on page 6 of the City’s Request for Qualifications
(Attachment 1). A short summary of these services include:
Pre-construction Services:
• Systems review – working with design team and contractor to review and analyze all
building, envelop, electrical systems, mechanical systems and controls to ensure highly efficient systems and practices are utilized throughout the project
• Operational cost estimating – working with design team and contractor to develop
systems costs and long-term performance projections for the project.
Construction and Acceptance Services:
• Commissioning Plan – write the BPSC project commissioning plan
• Review GC/CM submittals and shop drawings for commissioned systems
• Monitor and perform quality assurance checks of all test/adjust/balance work and recommend any changes or corrective actions necessary
• Review all building management and controls systems
• Coordinate and monitor all functional performance testing

• Assist with troubleshooting of any commissioned systems
• End of warranty period testing, review and report of commissioned building systems
UNRESOLVED ISSUES: None.
ALTERNATIVES: None identified
FISCAL EFFECTS: The cost of commissioning services has been anticipated since conception of the BPSC and monies have been included in the overall construction budget. The contract under
consideration by the City Commission is for a not to exceed total of $104,910 which includes up
to $12,610 for pre-construction services and up to $92,300 for construction phase services. The
fee section in on page 4 of the Elkhorn Commissioning Proposal.
