SUBJECT: Authorize the City Manager to Sign Lamme St. Fiber Conduit
Notice of Award and Contract Documents
MEETING DATE: September 16, 2019

RECOMMENDATION: Authorize the City Manager to sign Notice of Award and contract documents, once approved, with M&T Underground in the amount of $71,407.00.
BACKGROUND: Attached is a copy of the Notice of Award for the above referenced project.
The project generally includes the installation of fiber optic conduit on Lamme St. between Tracy Ave. and 3rd Ave. The segment was originally designed in 2017 and moves the conduit system
toward the completion of a redundant loop for the Downtown portion of the conduit network.
The contract is to be completed by October 31, following the issuance of the notice to proceed.
Two quotes were submitted as part of a limited solicitation, as allowed for projects under $80,000. The low quote was submitted by M&T Underground for $71,407.00. The Bid Tabulation for the project is attached. The quote is lower than the Engineer’s Estimate of
Probable Cost. Executed contract documents will be available online and retained in the City Clerk’s office.
A previous low bid was submitted by 406 Underground in the amount of $44,121 and a Notice of
Award was approved by the City Commission in June. The apparent low bidder was deemed non-responsive. Following Notice of Award, the firm was unable to meet the contract terms outlined in the solicitation.
UNRESOLVED ISSUES: None
FISCAL EFFECTS: This project will be paid for with approved funding from the FY19
Downtown Urban Renewal District Budget carried over to FY20.

You are notified that your Bid dated 9/3/19 for the above Contract has been considered. You are the
Successful Bidder and are awarded a Contract for Lamme Street Fiber, Schedule I.
The Contract Price of your Contract is Seventy-one thousand, four-hundred seven dollars and zero
cents ($71,407.00).
Four (4) copies of the proposed Contract Documents (except Drawings) accompany this Notice of Award.
Two (2) sets of the Drawings will be delivered separately or otherwise made available to you immediately.
You must comply with the following conditions precedent within [15] days of the date you receive this
Notice of Award.
1. Deliver to the Owner four (4) fully executed counterparts of the Contract Documents.
2. Deliver with the executed Contract Documents the Contract security [Bonds] as specified in the
Instructions to Bidders (Article 20), General Conditions (Paragraph 5.01), and Supplementary
Conditions (Paragraph SC-5.01).
3. Other conditions precedent:
Deliver with the executed Contract Documents the required insurance certificates.
Failure to comply with these conditions within the time specified will entitle Owner to consider you in default, annul this Notice of Award, and declare your Bid security forfeited.
Within ten days after you comply with the above conditions, Owner will return to you one fully executed
counterpart of the Contract Documents.
