IN CONSIDERATION OF THE PAYMENTS HEREIN SET FORTH AND THE SPECIFIC AGREEMENTS TO BE PERFORMED BY BOTH PARTIES HERETO AND WRITTEN IN THIS AGREEMENT, THE PARTIES HERETO BIND THEMSELVES TO THE TERMS AND CONDITIONS SET FORTH HEREIN. NO VERBAL AGREEMENTS SHALL BE BINDING UPON EITHER PARTY AND THIS AGREEMENT SHALL BECOME EFFECTIVE UPON EXECUTION BY A DESIGNATED REPRESENTATIVE OF THE CITY OF BOZEMAN. 2. COMPENSATION FOR LAND, IMPROVEMENTS, AND DAMAGES AS SHOWN ON EXHIBIT "A" (List acres and/or sq. ft. and improvements in the taking. ) Land: None Improvements: None Temporary construction permit: 13,041 S.F. 3. TOTAL COMPENSATION $1. 00 4. IT IS UNDERSTOOD AND AGREED THE CITY SHALL MAKE THE FOLLOWING DISBURSEMENT OF PAYMENT. A warrant in the amount of $1. 00 to be made payable to Highwood Estates Homeowner's Association and mailed to Highwood Estates Homeowner's Association. 1757 Hiqhland Boulevard. Bozeman. MT 59715. 5. THE GRANTOR, hereby grants the City of Bozeman, a Temporary construction Permit, as shown on Exhibit "A", attached hereto and made a part hereof, for the period of one year or the duration of the construction project, whichever is greater. 6. IT IS UNDERSTOOD AND AGREED THE Temporary Permit Area will be leveled and cleared of any debris after construction and left in a good, workmanlike condition. The City of Bozeman will construct north-south curb improvements 18 feet east of the west edge of the Permit Area, and remove the pavement section between the new curb and the east edge of the Permit Area. The City will restore the sod and irrigation sprinklers outside the new curb after grading the area smooth. (Continued on Next Page) -1- . .~ . ~ ., .. Project No. 94309 Parcel No. 1 (Continued from previous page) Paragraph 6 continued: The City will relocate the existing "Highwood Estates" sign to a new location agreeable to the Highwood Estates Homeowner's Association, on the project site. In addition, the city will restore the sprinklers along the north side of o'Connell Drive. 7. The terms, covenants, and provisions of this permit and agreement shall extend to and be binding upon the heirs, executors, administrators, personal representatives, successors, and assigns of the parties hereto.
