HomeMy WebLinkAboutEx 2 BPC 9 12 19 Resol 2019 06 PBD OutlineEXHIBIT 2: Bozeman Parking Commission ,9lt2l2Ùt9Page 1 of 2DBOZEMAN PARKING COMM¡SSIONRESOLUT¡ON 2019-06A RESOLUTION OF THE BOZEMAN PARKING COMM¡SS¡ON OF THE CITY OF BOZEMAN, MONTANA,RECOMMENDING THAT THE BOZEMAN CITY COMMISSION CREATE A NEW SECTION OF THEBOZEMAN MUNICIPAL CODE THAT ESTABLISHES.PARKING BENEFIT DISTRICTS, WITHIN THE CITY OFBOZEMAN, AND DEFTNES THETR CREAT¡ON, MOD¡FICATION, DISSOLUTION, AND OPERATION.WHEREAS, the Bozeman City Commission created and empowered the Bozeman Parking Commissionpursuant to Resôlution Numbers 1676,1839, 3803 , and 4577; and,WHEREAS, Montana Code Annotated 7-14-4621sets out the general powers of a parking commission;and,WHEREAS, the 2016 Downtown Strategic Parking Management Plan identifies a recommends (#19)"explore changes to residential on-street permit programs and evaluate ond potentially implement newresidential parking permit districts in the neighborhood north ønd south of the downtown commerciol district";and,WHEREAS, the Bozeman Parking Commission, and staff, have spent considerable effort researching anddeveloping an effective method for actively managing public parking resources in predominantly residentialareas impacted by a large, nearby, attraction such as downtown, commercial, university, school, hospital, etc.;and,WHEREAS, the use of parking Benefit Districts is an accepted parking industry best practice for managingpublic parking demand and occupancy in such areas; and,WHEREAS, the Bozeman Parking Commission has held several public engagement sessions to gatherlocal public opinion on how Parking Benefit Districts might best be implemented in Bozeman, especially to theimmediate North and South of the downtown area;NOW THEREFORE, BE lT FURTHER RESOLVED that the Bozeman Parking commission recommends thatthe Bozeman City Commission establish 'Parking Benefit Districts' as a new section of the Bozeman MunicipalCode, with consideration of the Bozeman Parking Commission's proposed concept outline for such ParkingBenefit Districts.NOW THEREFORE, BE lT FURTHER RESOLVED that in transmitting Resolution 2019-06, and ParkingBenefit District concept outline, to the Bozeman City Commission, the Parking Program Manager will includeproposed actual language for the Bozeman Municipal Code'

A geographically defined area, by ordinance, that actively manages public on-street parkingthrough the use of parking permits for residences, businesses, and transient parkers; as well asshort term timed parking (meters, etc.).o On-street occupancy is managed to the 85% standard (adopted by the BPC).o Resident parking permits are made available for purchase.o Employee, and Transient parking permits may be available for purchase, depending on level ofparking occupa ncy/inventory.o Short-term 'timed' on-street parking may be available in the district.Parking Benefit D¡str¡ct- Why have it?¡ The 2016 Downtown Strategic Parking Management Plan, Strategy # 19, identifies "explorechonges to existing residentiol on-street permit progroms and evoluote ond potentiallyimplement new residentiat porking permit districts in the neighborhood north ond south of thed ow ntow n com me rci o I di stri ct. "o The Parking Commission supports the goal of operating these new districts as Parking 'Benefit'Permit Districts. ln essence, providing a benefit to residents (or say "providing a benefit to theprimary user group") of such districts through lower permit fees (subsidized by external permitholders or "by secondary user groups"), the direct investment of surplus district-generatedrevenues, or other methods. Recognizing this may not be feasible within the current financialposition of the Parking Services Fund, but should be planned for in the near future'o Manage on-street parking in a predominantly residential area impacted by a large, nearby,attraction such as downtown commercial, university, school, hospital, etc. This is done not toguarantee a specific space, but so that residents have a reasonable expectation of on-streetparking near their residence.o Manage on-street parking in a commercial district to facilitate visitor parking turnover andencourage private shared off-street parking arrangements; reducing the need for multiple off-street parking lots and utilizing available land for other development.o Manage on-street parking in a neighborhood with a significantly mixed use of residential andcommercial developments, so as to provide maximum on-street parking opportunity for bothusage types.Parking Benefit District - How is it created, expanded, dissolved?o The Bozeman Municipal Code would need to have a section added that provides enablinglegislation for the creation of a "Parking Benefit District" - to include the 'objectives' recognizedby state law and/or judicial opinions. Specific'rParking Benefit Districts" would then be created,with legal description of their boundaries, by separate ordinance'o Petition from 6O% of dwellings or owners to create, expand, or dissolve all or a portion of anexisting Parking Benefit District.1 proposed framework for cons¡deration in creation of new parking benef¡t d¡stricts; not proposed for existing'residential'distr¡cts.
BPC9/2019: EXHIBIT 2City Commission or Parking Commission can initiate creation, expansion, or dissolution withoutpetition.When a d¡strict is proposed for creation, dissolution, or expansion, the City will notify affectedproperty owners and tenants by postal mail, as well as placing an advertisement in a newspaperof record, utilizing appropriate social and traditional media outlets, and physical signage in theaffected area (similar to those utilized for pending land use actions). Such notice shall occur at aminimum of 30 calendar days prior to any final action by the Parking Commission or CityCommission.Managing on-street occupancy to the 85% standard will be a consideration in the decision-making process for district creation, expansion, or dissolution. Likewise, the principle ThaI25%of vehicles parked in the (proposed)district, during peak hour, are registered outside the(proposed) district will also be a consideration'Minimum district size of ten (10) blocks, or 2500 linear curb feet'Parking Benefit District - How does it work?o An on-street parking permit allows the vehicle to park exempt from timed parking regulationsduring enforcement Periods.o A licensed driver residing in the district can purchase up to two (2) on-street parking permits forvehicles only. Trailers, campers, and other items are not eligible for parking permits in thedistrict.o Each residence in the district may purchase up to two (2) residential/business parking permits,and two (2) visitor's permits for use in the parking permit district.. A limited supply of Employee and Transient parking permits are available for purchase,depending on level of parking occupancy/inventory.o The number of Employee and Transient permits available expands/contracts to manage on-street occupancy to the 85% standard.o The district is enforced (permit and timed) utilizing license plate recognition technology, whichalso gathers parking occupancy data within the district; for further evaluation, modification, andmanagement of the district.Funding Considerations - How is it paid for?o Revenues derived from permit sales within the d¡str¡ct must cover the administrative andenforcement costs of the individual district.o Business and Transient permits are sold at a market driven rate'o Short term 'timed' parking is priced at a market driven rate, including event-based or other'demand' pricing opportunities.o Short term 'timed' parking is accomplished through the use of a Mobile Parking App, such aspassport, which requires only signage; drastically lowering capital costs for implementation andoperation.aaaa
BPC9/2079: EXHIBIT 2NEXT Steps -aoaAdopt BPC Resolution 2019-06: "Parking Benefits Concept" outline, recommending to the CityCommission that "Parking Benefit Districts" be created as a new and separate section of theBozeman Municipal Code.Transmittal of BPC Resolution 201-9-06 to the Bozeman City Commission, along with actual codelanguage that would implement the "Parking Benefits Concept" into the Bozeman MunicipalCode.Continue work towards the creation of a new "Parking Benefits District(s)" on the immediatenorth and south of the downtown area; including the definition of initial boundaries for thePa rking Benefit District(s).
