LICENSE FOR USE OF
THE CITY OF BOZEMAN'S LANDFILL BUILDING BY
EAGLEHEAD REPEATER ASSOCIATION
THIS LICENSE is an agreement made between the City of Bozeman, hereinafter referred
to as the "Licensor" and the Eaglehead Repeater Association hereinafter referred to as the
"Association. "
WHEREAS, the Licensor is the owner and operator of the building at the Bozeman City
Landfill ;
\VHEREAS, the Association desires to use t..1.e Landfill building for locating the
Association's 450 repeater;
WHEREAS, the location of the Association's repeater at this location will enable the
Association to establish a communication link between Bozeman and Big Sky;
WHEREAS, the Association's repeater will aid in public safety by establishing this
communication link.
IN CONSIDERATION OF the Association's promises herein, Licensor hereby gives
permission, revocable, and terminable as herein provided, to the Association to locate and
maintain at the Landfill building a 450 repeater for the terms and conditions set forth below
which the Association promises to comply and abide with:
1. This permission is given to the Association as an accommodation to the
Association and shall be rent free. Association acknowledges the title of Licensor
to the above-described property and agrees never to deny such title or to claim
at any time any interest or estate of any kind or extent whatsoever in the
property, by virtue of this license or its occupancy or use hereunder.
2. The Association shall use only that portion of the Landfill building as provideu
in Exhibit A attached hereto and incorporated by reference.
3. The Association shall exercise its privilege at its own risks and agrees to
indemnify and hold Licensor harmless from any and all liability, loss or damage
the Licensor may suffer as a result of any and all claims, demands, costs, or
judgments against it arising out of, or in any way connected with, the occupation
or use of this property by the Association or its members, employees, guests,
invitees.
4. The Association's privileges hereunder shall not be assignable by the Association,
in whole or in part.
5. The Licensor reserves the right to revoke or terminate the permission hereby

given at any time by giving the Association at least seven (7) days written notice
of such revocation or termination, except the Licensor may, at its election, revoke
or terminate the permission forthwith at any time if the Association shall fail to
comply with or abide by each and all the provisions hereof. Upon revocation,
surrender, or termination of the permission hereby given, the Association shall
quietly and peaceably surrender the portion of the premise occupied by the
Association in as good condition as same or at the time the Association's entry,
and shall remove said repeater at its own expense, and if the Association shall fail
to do so, Licensor shall have the right to make such removal at the Association's
expense.
6. The Association shall at all times exercise due diligence in the protection of the
Licensor's property against damage,
7. Any amendments or modifications to this agreement or any provision herein shall
be made in writing and executed in the same manner as the original document and
shall, after execution, become part of this agreement.

The above license with all provisions and conditions thereof is hereby agreed to and
