AGREEMENT
THIS IS AN AGREEMENT entered into this 1st day of
November , 1982, between the CITY OF BOZEMAN, herein
referred to as Owner, and RONALD N. HECHT, herein referred to
as User, for the purpose of establishing the right to use a portion
of Beall Street; indemnifying and saving harmless the City of Bozeman
in any litigation arising during the period of use; revocation of the
agreement.
In consideration of the mutual covenants and agreements herein
contained to be kept and performed by the parties hereto, it is
mutually agreed as follows:
1. That the Owner hereby grants unto the User the right to
occupy and use all that portion of dedicated Beall Street
lying north of and adjacent to Lot 16, Block 12, in the
Springbook A ddition to the City of Bozeman, Montana.
2. That the User, his heirs, administrators, successors and
assigns, shall for themselves and for their heirs keep and
maintain said dedicated portion of Beall Street in an orderly
and sightly condition and indemnify and save harmless the
Owner in any litigation arising during the period of this
granted use.
3. That the right of occupancy herein granted is subject to
revocation upon sixty (60) days' written notice to the User
or his heirs, executors, administrators or assigns, and upon
receipt of such notice the User shall without delay and at
his sole expense remove any and all encroachments or
improvements of whatever nature that may have been erected
or constructed under the terms of this granted use of the
subject property.
