AGREEMENT FOR USE OF WASTE WATER TREATMENT PLANT SITE
BETWEEN
THE CITY OF BOZEMAN AND MONTANA STATE UNIVERSITY
THIS AGREEMENT, made and entered into this 8th day of
December , in the year of our Lord one thousand nine
hundred seventy-one between the city of Bozeman, a municipal
corporation, party of the first part, and Montana State Univer-
sity, party of the second part;
WIT N E SSE T H :
WHEREAS, the party of the first part is the legal owner
of the Bozeman Waste Water Treatment Plant site, and
WHEREAS, the party of the second party desires to place
a mobile laboratory of the Department of Civil Engineering and
Engineering Mechanics on the above site and connect to existing
and/or constructed facilities to operate the laboratory as a
classroom and research facility, and
WHEREAS, it is felt to be mutually beneficial to both par-
ties to exchange information, jointly use unique equipment, and
to conduct research on municipal sewage.
NOW, THEREFORE, in consideration of an annual fee of Fifty
Dollars ($50.00) due and payable to the party of the first part
upon the execution of this agreement and annually thereafter on
or before the 1st day of July of each year, beginning July 1,
1972, the party of the first part covenants and agrees that:
1. All rights to scientific and engineering discoveries
out of the use of this mobile laboratory are the ex-
clusive property of the party of the second part.

2. Access to personnel authorized by the party of the
second part will be allowed to the site during all
reasonable hours for laboratory or research purposes.
Such access must be cleared with the plant operator.
3. The right to connect to existing and/or constructed
facilities in such a manner so as to not interfere
with normal operations of the plant. The party of
the first part further agrees to supply normal amounts
of water and electrical power and to allow connection
to the sanitary sewer, however, all installation and
maintenance costs of these connections will be borne
by the party of the second part.
4. Fire protection for this laboratory will be furnished
by the Bozeman Fire Department.
The party of the second part hereby covenants and agrees:
1. All public news releases or ~tat8man~ concerning
the results of laboratory work will be cleared by
the City Manager prior to release.
2. To hold the party of the first part harmless from
any liability or damage arising from ~njuries to
personnel, students, or property under the direction
of the party of the second part.
3. To install all utilities and any continuous sampling
pipelines and equipment and in a manner not to inter-
fere with normal operations.
4. All plans and materials for any installation or alte-
ration shall be approved by the City Engineer prior
to commencement of work.
5. In the event that this agreement is terminated, all
permanent installations (excluding mobile laboratory
and apparatus) will become property of the party of

the first part and the site will be left in substan-
tially the same condition as originally existed.
6. To block and skirt and maintain the mobile laboratory
in such a manner as to be aesthetically comparable
with the surrounding area.
It is further mutually agreed that this agreement may be
terminated ninety (90) days from receipt of written notifica-
tion by either party.
IN WITNESS WHEREOF, the said parties have hereunto set
their hands and seals the day and year above written.

For the purpose of this agreement the term l1public news 11 shall
not include oral or written scientific reports or papers presented
to engineering or scientific societies. Such scientific reports will
not reQuire clearance by the City Manager.
