A G R E E MEN T
THIS AGREEMENT, Made and ;ptered into this 20th day
of June, 1962, by and between JOSEP ~Y and JUNE B. MAY, husband
and wife, of Bozeman, Montana, the parties of the firs.t part, and
the CI'IY OF BOZEMAN, a municipal corporation of the state of Montana,
the party of the second part,
WIT N E 5 SET H:
WHEREAS, the parties of the first part are the owners of
the residence located at 1431 south 4th Avenue, Bozeman, Montana,
which said residential property faces both 4th Avenue and Lincoln
Road, and
WHEREAS, said Lincoln Road has heretofore, pursuant to
the order and direction of the City Commission of the City of
Bozeman, Montana, been temporarily closed, and
WHEREAS, said parties of the first part have applied for
---~- a building permit to construct a garage to face said 4th Avenue
but which said garage will be within one foot of said applicants'
property line bordering Lincoln Road, and
WHEREAS, the Board of Adjustment of the City of Bozeman
has authorized said parties of the first part to construct said
garage in the location proposed provided that the said parties of
the first part, in writing, agree to remove said garage from the
proposed location in the event that said Lincoln Road is reopened.
NOW, THEREFORE , the parties of the first part herein, for
themselves, their heirs, executors, administrators and assigns,
covenant and agree that if the Board of Adjustment of the city of
Bozeman, issues a permit to the said parties of the first part to
construct a garage on said premises facing 4th Avenue and so
located as to be within one foot of their property line bordering
Lincoln Road, that the said parties of the first part shall within
sixty (60) days after the reopening of said Lincoln Road remove

said garage from the proposed location and to relocate the same
so as to conform with the requirements of the zoning ordinances
and regulations of the city of Bozeman.
IN WITNESS WHEREOF, the parties of the first part have
hereunto set their hands and the party of the second part has here-
unto set ies hand by it's Mayor and it's Clerk of the City
Commission, each thereunto duly authorized, and has caused it's
corporate seal to be affixed as of the day and year first herein-
before written.
