THE CITY OF BOZEMAN

THIS MEMORANDUM of agreement made this 3rd day of June, 1939,
between The City of Bozeman, Montana, hereinafter called The City,
and W. E. Kreuger, of Bozeman, Montana, hereinafter called the
purchaser, witnesseth:
That The City agrees to sell to the purohaser.' and the purchaser
agrees to buy from The City, upon the terms and conditions hereinafter
set forth, the following described real property in The City of Bozeman,
Gallatin County, Montana, de so ri bed as follows:
Beginning at a point in the east line of Bozeman;
-..- Avenue, South, said point being 12.7 feet south of
the southwest corner of~ "e" of the original
Townsite of Bozeman; thence easterly 2~O feet, more
or less, to a point 19 feet south of the southeast
corner of Lot 29 of said Blook "C"; thence south 2.33
feet to the north line of B~ok street; thence west
along the north line of said Babcock street 2~0 feet,
more or less, to the east line of Bozeman Avenue,
South,; thenoe north a.s feet more or less, to the
point of beginning.
The prioe to be- paid by the purchaser is $189.65 and is
to be paid as follows: $100.00 upon the sign.ing of this agreement,
the reOC1pt whereof is hereby aoknOWled~d by The City, and the
remainder of the purcbasez prioe, $89. 5, to be paid within 90
days from the date hereof; and upon such final payment The City
will oonvey said real property as above described to the purohaser
by a good and suffioient deed" provided, that final payment be
made within the time limited herein, time being of the essenoe of
this agreement, and if suoh payment be not made this agreement
shall be null and void and to all intents and purposes, legal and
equitable, as if the same had not been made.
--'"-- This agreement is made on behalf of The City pursuant to
the action of the City Commission of The City at its regular meeting
on June 3, 1939, and entered in the reoorda of the proceedings ot
suoh meeting, at whioh the purohaser waS present and agreed orally
as above set forth.
In Witness Whereof The City has oaused this agreement to be
exeouted by its Mayor and Clerk of The City Commission, thereunto
duly authorized, and its oorporate seal to be affixed hereto; and
the purohaser haa signed in proper person~ as of the day and year
first above written. Signed in duplioate.

This letter is written to you to aooept the
offer of aale of that traot of land adjoining my pro-
perty at the N.E. corner of the interseotion of Bozeman
~enue and Babcook street in the City of Bozeman as
that property is described and as that offer is set
forth in a letter addressed to me by M. X.Henderson.

This acoeptanoe of the offer is made on the
following oonditions:
That the purohase price of One hundred eighty nine

This refers to a Memorandum of Agreement made
by and between The City of Bozeman and W. E. Krueger
of Bozeman, Montana on June 3rd, 1938, relative to
the purchase of a certain tract of land at the
corner of Bozeman Avenue South and Babcock Street
in the City of Bozeman.
