NOTES CORRESPONDING TO SCHEDULE B, PART II (of American Land Title Company, File No.: 1-108821, Commitment Date: August 31, 2018 at 8:00 A.M.) Exceptions 1-3, 5, 6, 15-17) Exceptions which are general in nature or not survey related and not shown on this survey. Exception 4) Restrictive Covenants appearing of record in Film 124, page 1231 and as Document No. 2072618, but omitting covenants or restrictions, if any, based on race, color, religion, sexual orientation, familial status, marital status, disability, handicap, national origin, ancestry, or source of income, as set forth in applicable state or federal laws, except to the extent that said covenant or restriction is permitted by applicable law. This Declaration of Reservations and Protective Covenants includes easements and setbacks which did not appear on the Plat of Walker Property Subdivision but which are shown on this survey, particularly the 10' utility easement and 1' no access strip along Springhill Road and 10' utility easement along Reeves Road West. Exception 7) Right of Way Easement to The Montana Power Company recorded March 3, 1967 in Book 153 of Deeds, page 337, records of Gallatin County, Montana. This easement, for an electric power line and communication system is a bit ambiguous. It calls for the line to be "Along the south R/W fence of Interstate 10...". Both Interstate 90 and US Highway 10 are located nearby and the south right-of-way fence of either would be some distance away from the subject property. The description continues "...and in the SE1/4 Section 26...". It is unclear if the "and" limits the first call or is in addition to the first call. Probably the former, but ambiguous. Exception 8) Right of Way Easement to The Montana Power Company recorded October 3, 1974 in Film 26, page 321, records of Gallatin County, Montana. This easement is for a gas line and is blanket in nature. The location is in the S1/2SE1/4, and the N1/2SE1/4, of Section 26, and is described as "to follow fence as close as possible". This easement is unretraceable and is not shown on this survey. Exception 9) Right of Way Easement to The Mountain States Telephone and Telegraph Company recorded May 1, 1980 in Film 56, page 220, records of Gallatin County, Montana. This easement is located along, and contiguous to, the south right-of-way line of Interstate 90 and does not affect the subject parcel. Exception 10) Right of Way Easement to The Montana Power Company recorded September 30, 1931 in Film 66, page 264 and recorded October 8, 1981 in Film 66, page 617, records of Gallatin County, Montana. This Easement is blanket in nature, and is for an electric power line across the W1/2E1/2SE1/4 of Section 26. The easement is not retraceable and is not shown on this survey. Exception 11) Grant of Mutual Easement For Ingress, Egress and Utilities between Joseph J. Colombo, Jr., Janet E. Colombo, T. Bret Haggerty, Michael A. Basile and Jane E. Basile, parties of the first part, and William D. Mowen, Jr. and Timothy H. Pinson, parties of the second part, dated March 8, 1996 and recorded March 19, 1986 in Film 161, page 1584, as Document No. 321344, records of Gallatin County, Montana. This easement is located on Lots 1A1 and 2A of the Amended Plat of Lots 1A, 2, 3, and 4A of Block 4 of Walker Property Subdivision and does not affect the subject property. Exception 12) All easements, notes and disclosures as contained on recorded plats of record. All easements, notes and disclosures which are able to be shown graphically, are depicted on this survey. Exception 13) Bargain and Sale Deed recorded July 27, 1964 in Volume 146 of Deeds, page 166, records of Gallatin County, Montana. This Bargain and Sale Deed is for right-of-way located south of the Northern Pacific Railroad right-of-way and does not affect the subject parcel. Exception 14) Designation of Controlled Access Highway, State Highway Project No. No. RS-411-1(2)0 recorded January 21, 1986 in Film 90, page 3671, records of Gallatin County, Montana. This document establishes road approaches and limits access along Springhill Road. LEGAL DESCRIPTION Lot 1A of Block 6 of the Amended Plat of Lots 1A, 2, 3, and 4A of Block 4 of Walker Property Subdivision (a Planned Unit Development), situated in the SE1/4 of Section 26, Township 1 South, Range 5 East, P.M.M., Gallatin County, Montana, according to the official plat thereof on file and of record in the office of the County Clerk and Recorder of Gallatin County, Montana. [Plat J-164-B] SURVEYOR'S NOTES 1)The underground gas line along the southwesterly boundary of the property does not appear to be within the gas easement, per marks on the ground in response to locate request. 2)The underground telephone line along northeasterly boundary appears to extend outside of 10' utility easement per marks on the ground in response to locate request.
