Appoint CM Surratt to the MT Commission on Community Service Commission Memorandum REPORT TO: Honorable Mayor and City Commission FROM: Andrea Surratt, City Manager SUBJECT: Appoint City Manager Andrea Surratt to the Montana Commission on Community Service to a Term Expiring July 1, 2022 MEETING DATE: July 15, 2019 AGENDA ITEM TYPE: Consent RECOMMENDATION: Appoint City Manager Andrea Surratt to the Montana Commission on Community Service to serve a term the remainder of a three year term, commencing upon receipt of approval by the Governor’s Office, and expiring July 1, 2022. BACKGROUND: The Montana Commission on Community Service was created by the 1993 Legislature at the Request of the Governor (MCA 90-14-101ff), in an effort to support community-based volunteer programs focused on addressing critical community needs. The Commission is a diverse, non-partisan body representing a broad cross-section of community service interests and statewide leadership in Montana. The Commission’s vision for Montana is healthy, vibrant communities where individuals are empowered to strengthen communities through service and volunteerism. Governor Steve Bullock’s Office has requested that City Manager Surratt serve as the Local Government Representative on the Commission. The City Manager’s employment agreement reads: ARTICLE IX. HOLDING OFFICE. Commission approval is needed before the Employee agrees to hold office is any professional, business, or civic organization. While a board member of this governor-appointed advisory commission is not considered a “public officer” or a “state officer” under 2-2-102, MCA, this commission’s own bylaws contain this: “By assuming office, a commission member…” (See section 2 “Obligations of the Individual Commission Member,” page 2). The bylaws also require commission members to follow the ethics rules in Title 2, Ch 2 for public officers and public employees. The bylaws also distinguish elected officers in Art IV (Chair and Vice Chair). Commission approval of this appointment seems in line with the intent of the employment agreement language. 59 ALTERNATIVES: As suggested by Commission. FISCAL EFFECTS: None.
