Home My WebLink About91- Sweet Pea Inc. . ." ___ ____n. .--..-...,.-...----... -"...._,~ ----... -.-.-- .---- -. ,.-.---- --------~- \ SPECIAL PERMIT FOR PARK USE THIS AGREEMENT, made and entered into this 25th day of February 1991 , by and between the CITY OF BOZEMAN, a muni- cipal corporation, hereinafter referred to as the City, and SWEET PEA, INC., a Montana Corporation, of the City of Bozeman, Montana, hereinafter referred to as the Permittee, WIT N E SSE T H That the said City, for and in consideration of the rents and covenants hereinafter mentioned to be paid and performed by the Permittee, does hereby give Permittee the particular right to use all of Lindley Park, located on East Main Street in the City of Bozeman during the period August 2, 3, and 4, 1991, for the purpose of conducting the Sweet Pea '91 Festival. The Permittee, in payment for the use of the above-described premises, hereby covenants and agrees to pay to the City the sum of One Hundred Fifty and no/100 Dollars ($150.00) to cover costs of upkeep and associated services on said premises during the term of this permit on or before August 1, 1991 . The Permittee also understands that it may be requested to participate in restoration of park grounds should there be extensive damage done to such. IT IS EXPRESSLY UNDERSTOOD AND AGREED that the Permittee agrees to maintain Lindley Park and leave all facilities in a clean, safe and sanitary manner, at no cost to the City, and shall comply with all ordinances, rules, statutes and regulations applicable thereto. Fai lu re to do so wi II result in the Permittee paying all costs incurred by the City to return the premises to a clean, safe and sanitary condition. Permittee further agrees to indemnify and hold harmless the City, its officers. agents and employees against and from any and all actions, su i ts, claims, demands, costs, expenses ( including attorney's fees) or liability of any character whatsoever, brought or asserted for injuries to or death of any person or persons, or damages to property arising out of, resulting from or occurring in connection with the Sweet Pea Festival. The applicant states that he/she is of legal drinking age (if applying for a waiver ~ to the open container ordinance) and that in consideration of being granted a park . reservation/open container waiver, the applicant and those attending the function. hereby releases the City of Bozeman and its officers and employees from any and all claims for damages which may arise out of said function and furthermore agrees to take full responsibility for the conduct of the function. including. but not limited to seeing that all laws, ordinances. and regulations are obeyed by those in attendance, preventing consumption of alcoholic beverages by those persons under 21 years of age. prohibiting the serving of alcoholic beverages to those people who appear to be impaired or under the influence of alcohol, prohibiting those who appear to be impaired or under the influence of alcohol from operating a motor vehicle. by providing a safe transportation plan for those in attendance by using designated drivers. the "Home Free" program or some similar plan. and leaving the park in a safe. sanitary and clean condition.
