Montana. hereinafter referred to as the Lessee, WITNESSETH: That the said Lessor, for and in consideration of the rents and covenants hereinafter mentioned to be paid and performed by the Lessee. does hereby lease, let and demise unto the said Lessee all of Lindley Park, located on East Main Street in the City of Bozeman. TO HAVE AND TO HOLD the above-described property during the period August 2, 3 and 4. 1985, at which time this lease and the rights of the Lessee herein shall terminate. The Lessee. as rent for the above-described premises, hereby covenants and agrees to pay to the Lessor the sum of One Hundred Fifty and no/1 00 Dollars ($150.00) to cover costs of upkeep and associated services on said premises dur- ing the term of this lease and which rental shall be paid to the Lessor on or be- fore August 1. 1985. The Lessee also understands that it may be requested to participate in restoration of park grounds should there be extensive damage done to ' such. IT IS EXPRESSLY UNDERSTOOD AND AGREED that the Lessee agrees to maintain Lindley Park and leave all facilities in a clean, safe and sanitary manner, at no cost to the Lessor. and shall comply with all ordinances, rules. statutes and regulations applicable thereto. Failu re to comply wi II result in the Lessee paying all costs incurred by the Lessor to return the premises to a clean. safe and sani- tary condition. Lessee further agrees to indemnify and hold the Lessor harmless from any and all claims, demands. causes of actions, damages, judgments and attor- ney fees the Lessor may incur or are asked to incur as a result of the conduct, activities or omissions of the Lessee or participants of Sweet Pea '85. SECURITY: Sweet Pea will provide Security Service personnel as foll~s: l~o uniformed personnel from a private security servic, ~ho ~ill b, located at the main stage in the Lindley B~l from 7 to 11 p.m. Friday & Saturday (August 2 & 3) and 7 to 10 p.m. Sunday (August 4). lh, City of Bozeman is asked to provide security as foll~s: Two uniformed police officers ~ho will roam Lindley Park but concentrate their time around the perimeter of the Lindl,y B~l area where the main concerts occur. They should check the south~est corner of the park near the c,metery frequently. When the concerts let out please check the traffic situation at East Main and Cypress and direct traffic as nectssary. They are requested during the foll~ing times: 7:30 to 10:30 p.m. Friday & Saturday (August 2 & 3) and 6:30 to 9:30 p.m. Sunday (August 4). Sweet Pea will reimburse the City of Boztman for its expenses in providing this service, and will contract ~ith and pay its private security service separately. 2. S/HITATllJ4 Sweet Pea will contract with a private company to provide and maintain 10 chemical toilets to be located along the road into the Pavilion parking area. Swee t Pu requnts that the City of Bozeman provide its existing indoor toilets (just south of the Childrens Activities area) and that th'y be stocked and cleaned as needed during the festival (August 2,3 and 4) by Parks Department personnel. Sweet Pea also requests that these personnel stop at Sweet Pea Headquarters tent (just south of the Concessions aru) when they visit the Park, to increase communication ben.een the two organi zat ions.
