THIS INDENTURE, made and entered into this 3rd day of August ,
1984, by and between the CITY OF BOZEMAN, a municipal corporation, hereinafter
referred to as the Lessor, and SWEET PEA 184, of the City of Bozeman, Montana,
hereinafter referred to as the Lessee,
WITNESSETH
That the said Lessor, for and in consideration of the rents and covenants
hereinafter mentioned to be paid and performed by the Lessee, does hereby lease,
let and demise unto the said Lessee all of Lindley Park, located on East Main Street
in the City of Bozeman. TO HAVE AND TO HOLD the above-described property
during the period August 3, 4 and 5, 1984, at which time this lease and the rights
of the Lessee herein shall terminate.
The Lessee, as rent for the above-described premises, hereby covenants
and agrees to pay to the Lessor the sum of One Hundred Fifty and no/l00 Dollars
($150.00) to cover costs of upkeep and associated services on said premises dur-
ing the term of this lease and which rental shall be paid to the Lessor on or be-
fore August 3, 1984.
IT IS EXPRESSLY UNDERSTOOD AND AGREED that the Lessee agrees to
maintain Lindley Park and leave all facilities in a clean, safe and sanitary manner,
at no cost to the Lessor, and shall comply with all ordinances, rules, statutes and
regulations applicable thereto. Failure to comply will result in the Lessee paying
all costs incurred by the Lessor to return the premises to a clean, safe and sani-
tary condition. Lessee further agrees to indemnify and hold the Lessor harmless
from any and all claims, demands, causes of actions, damages, judgments and attor-
ney fees the Lessor may incur or are asked to incur as a result of the conduct,
activities or omissions of the Lessee or participants of Sweet Pea 184.

IN WITNESS WHEREOF, the parties hereto have caused this instrument to
be executed this 3rd day of August 1984.
