In consideration of the mutual covenants and agreements herein contained, the receipt and sufficiency whereof being hereby acknowledged,the parties hereto agree to amend the Agreement as follows: 1. Extension of Term. Section 2 of the Agreement is extended until completion of construction services. 2. Scope of Services. Contractor will perform the work and provide the services in accordance with the Scope of Services attached hereto as Exhibit A and by this reference made a part hereof. 3. Payment. City agrees to pay Contractor the amount specified in the Scope of Services. Any alteration or deviation from the described services that involves additional costs above the Amendment amount will be performed by Contractor after written request by the City, and will become an additional charge over and above the amount listed in the Scope of Services. The City must agree in writing upon any additional charges. 4. This phase of the project will consist of bidding services, construction contract administration and observation, and construction staking. A detailed scope of services for these tasks is outlined below. Phase 1—Project Initiation This phase of the project includes preparation of the scope of work and amendment. Phase 2—Construction/Contract Administration This phase of the project will consist of construction bidding services, contract administration and construction observation tasks,including the following: • Prepare bid advertisement • Contractor coordination throughout bidding,prepare up to two addenda if needed • Facilitate pre-bid meeting,prepare agenda and distribute minutes • Attend bid opening,prepare bid tabulation and recommendation of award letter • Process contract documents for a single contract (four copies) • Facilitate pre-construction meeting,prepare agenda and distribute minutes • Shop drawing review • Construction observation and documentation (assume observation for 8 hours each day and a 30-calendar day construction contract) • Respond to Contractor RFI's • Construction materials testing coordination and review • Process pay applications submitted by Contractor and any necessary work change directives, verify material quantities on all contractor pay requests • Process the Certificate of Substantial Completion,coordinate final inspection,prepare punch lists and verify completion • Prepare as-built (record) drawings • Prepare City of Bozeman close-out submittal • Conduct two-year warranty walkthrough,prepare punch list and verify completion Phase 3—Construction Staking This phase of the project consists of the construction layout, anticipated to include the following: • Stake demolition limits • Stake subgrade cuts for streets one time;25-foot spacing;2 to 3-foot offset from back of curb • Stake curb and gutter one time; 25-foot spacing, PC's and PT's • Stake back of curb at storm inlet relocations • Stake horizontal layout of curb ramps with vertical benchmark for grade one time • Stake signs one time • Stake signal poles one time • Layout striping one time The following items are not expected to be needed for this project and are therefore specifically excluded from this scope of work: • Materials testing(By Contractor or City Term Contract) • SWPPP permitting and operation (By Contractor) Fees and Billing Arrangements: Phase Fee 1. Project Initiation $950 I2. Construction Observation/Contract Administration $41,470 3. Construction Staring $9,100 Total $51,520 Sanderson Stewart will bill for its services on a time and materials basis with a not to exceed amount of$51,520. Sanderson Stewart shall submit invoices to the Client for work accomplished during each calendar month. Schedule The anticipated schedule for this project will be based on the anticipated 30-calendar day construction contract.
