Klewin - Suit Over Storm Runoff SolutionFrom:Chris Mehl To:Terry Cunningham; Agenda Subject:Fwd: Suit Date:Thursday, June 13, 2019 3:49:27 PM Attachments:20190613_152120.jpg 20190613_152142.jpg Sent from my iPhone Begin forwarded message: From: "Kurt Klewin" <kurt.klewin@gmail.com>To: "Cyndy Andrus" <CAndrus@BOZEMAN.NET>, "Jeff Krauss" <Jkrauss@BOZEMAN.NET>, "Chris Mehl" <CMehl@BOZEMAN.NET>, "I-HoPomeroy" <IPomeroy@BOZEMAN.NET> Subject: Suit Mayor Andrus, I have contacted the city on numerous occasions over the last two years in regardsto the continued allowance of building permits in the Southbridge subdivision in Bozeman. In my contacts with the city I have made it clear to them that all thesehomes are being built upon and an extremely high water table. The home I own and my neighbor's home continually pump water from all around our foundationsinto the city streets 365 days a year. The city engineers have come out here and basically told me that I was free to do my own engineering, have it approved by the city, and pay for the water to be putinto a storm sewer and taken somewhere else versus just being collected in the streets and diverted to an inadequate holding pond. I have given the city almost two years to try to come up with an engineeringsolution to this problem to no avail. Hence, I am here by giving the city 30 days to contact me with a solution to this issue or I will be filing suit against the city ofBozeman to recoup the cost of engineering and installing adequate sewer water diversion in our neighborhood, along with the monetary costs of communitymembers continually having to pump water from around their homes into the streets, and associated legal fees. I have attached what our street looks like after we get rain fall. At a minimum, the street should be closed until repairs can be made. Additionally, we have been in contact with an attorney who would like to represent all of the homeowners in aclass-action status if we do not get resolution from the city. I am not sure how you can continue to permit homes to be built in a high water table area and then not provide the associated engineering and adequate stormrunoff for those areas. I look to hear from you with a formal engineering plan and solution by July 13th. Thank you for your time. Regards, Kurt Klewin2014 Commonwealth St Bozeman
