Approve the Fire Code Board of Appeals Rules of Procedure Commission Memorandum REPORT TO: Honorable Mayor and City Commission FROM: Brenda Sweeney, Deputy City Clerk Robin Crough, City Clerk SUBJECT: Fire Code Board of Appeals Rules of Procedure MEETING DATE: June 10, 2019 MEETING TYPE: Consent RECOMMENDEDATION: Approve the Fire Code Board of Appeals Rules of Procedure dated April 1, 2019 BACKGROUND: The Fire Code Board of Appeals (authorized by Section 108 of the International Fire Code) was established under Bozeman City Ordinance 1444, passed, adopted and approved by the City Commission on August 18, 1997. The Board is authorized to “hear and decide appeals of orders, decisions or determinations made by the Fire Chief relative to the application and interpretation of the International Fire Code” (Sec 108 Fire Code) and to “determine the suitability of alternative materials and types of construction……and to provide reasonable interpretation of the International Fire Code as adopted by the City of Bozeman” (Ord. 1444) The Bozeman Municipal Code provides for the adoption of specified codes. The Bozeman City Commission established by Ordinance No. 1444 the Fire Code Board of Appeals in accordance with Section 108 of the International Fire Code and further mandating that the Fire Code Board of Appeals conduct business in accordance with procedures adopted by the Board and approved by the City Commission. At the Board’s first annual business meeting on April 1, 2019 the Board reviewed and discussed the Fire Code Board of Appeals Rules of Procedure which resulted in an established set of rules. The rules were adopted with a unanimous vote of the Board members present. The Bozeman City Commission needs to approve the Board’s Rules of Procedure pursuant to 2.02.160.D, BMC. Please see the attached Summary and Rules of Procedure. The Board of Appeals shall consist of five members, appointed by the City Commission, who are qualified by experience and training to pass upon pertinent matters. The Fire Chief, or his designee, shall be an ex officio member and shall act as Secretary of the Board. Appointments are for a period of three years.
