THIS AGREEMENT made and entered into this 2QtlL_day of Octo-
~._-~, A.D. 19!+9, by and between DUANE R. STRAITON, doing
business as the Culligan Soft Water Service of Bozeman,

CITY OF BOZEMAN, a municipal corporation of the state of rrontan a,
in Gallatin County, the larty of the Second Part,
WIT N E SSE T H:
WHBR.8AS, on the .26th day of Q~1Q.Q.er _, 19)+9, the Party of
the First Part applied for and was issued by the party of the
Second Part a building permit to build and construct a water
treatment plant on West Main street in the City of Bozeman, in
Business - Residence District Number 1 , and
iNHEREAS , the nature of the business to be carried on by
the Party of the First Part in said plant is such that large
quantities of waste water are generated which must be disposed
of through the sewage system of the City of Bozeman; and

would possibly result in the said system becoming overloaded;
and
VV'HEREAS , by reason of the aforemedioned condition, it is
necessary that certain agreements between the parties hereto as
to the disposition of sewage from the plant of the Party of the
First Part be made.
NOW 'rIn~REFORE, in consideration of the mutual covenants and
agreements hereinafter contained upon the part of the parties here-
to to be kept and performed, it is mutually agreed as follows:
1. The Party of the First Part is hereby authorized by the
party of the Second Part to connect the sewage drains from the
aforesaid water treatment plant to the sanitary sewer system of
the Party of the Second Part, in such a manner as may be prescribed
by the party of the Second Part; provided, however, that the
Party of the Second Part hereby reserves the right and the Party
of the Firs t Part here by gra::1 ts to tho Party of' the s-eccna--"Fart
the right to limit the amount of water or waste deposited in
said sanitary seVier at any time when, in the discretion of the
Party of the Second Part, such limitation is necessary.
2. The Party of the First Part agrees to build arrl maintain
sumps for all floor drains, such sumps to be approved by the
Party of the Second Part.
3. That if and when adequate storm sewers are built and con-
structed adjacent to the said water treatment plant of the Party
of the First Part into which the sewage from said plant could
be drained, the party of the First Part agrees that all floor
drains will be disconnected from the sanitary sewer and connected
to such storm sewer at the expense of the Party of the First Part

and in such a manner as may be prescribed by the Party of the
Second Part.
~.. That if, in the conduct of his business, the Party of the
F'irst Part shall use a water well or wells, connection with such
well or wells will be made in the manner prescribed by the Party
of the Second Part, on the basis of detailed drawinGs of such
proposed connections submitted in advance to the Party of the
Second Part by the Party of the First Part.

of the Party of the First Part, to measure the water taken -- -......:................
therefrom as a basis for sewer rental as prescribed by the
Ordinances of the City of Bozeman, and the Party of the First
Part hereby agrees to pay such sewer rental upon water taken
from the said well or wells.
IN WITNESS WHEREOF, the Party of the First Part has hereunto
set his hand and seal and the Party of the Second Part has here-
unto set its hand by its Mayor and Clerk of the City CODMission,
each thereunto duly authorized, and has caused its corporate seal
to be affixed, both as of the day and year first hereinbefore
