SANITARY SEWER AGREE~NT
Between Hugh F. and Grace E. Biggs, husband and wife, residing at
1506 West Babcock Street, Bozeman, Montana, and the City of Bozeman,
Montana.
Mr. and Mrs. Biggs are the owners of a tract of land located in the
Nwk, SW~ of Section 12, Township L South, Range ) ~a5~, M.~.M. comprising
of approximately 2.91 net acres.
They desire to connect onto the City Sanitary Sewer constructed
under Special Improvement District #432. A total area charge for the
2.91 acres at $375.00 per acre would be $1091.25.
It is agreed by both parties to this agreement, that due to the
fact that the southerly two-thirds of the property area would of necessity
have to be sub-divided and subsequently would not apt to be using the
sanitary sewer, that under the circumstances only the northerly 200 feet
of said property, namely 200' X 157' or an area of .7208 acres containing
the present Biggs residence be assessed for the sanitary sewer connection
at this time, in the amount of $270.30, and further that no part of the
balance of the total tract area be connected to the sanitary sewer,
until and unless the balance of the amount totaling $820.95 be paid to
the City of Bozeman, Montna.
The undersigned further covenant and agree to pay to the City of
Bozeman, Montana, prior to making said connection to the sanitary sewer
system of the City of Bozeman, all regular connection fees and costs
which may be in effect at the time said connection is made.
