1. IN CONSIDERATION OF THE SPECIFIC AGREEMENTS MADE BY BOTH
PARTIES WRITTEN IN THIS AGREEMENT, THE PARTIES HERETO BIND
THEMSELVES TO THE TERMS AND CONDITIONS.SET FORTH HEREIN. NO
VERBAL AGREEMENTS SHALL BE BINDING UPON EITHER PARTY AND THIS
AGREEMENT SHALL BECOME EFFECTIVE UPON EXECUTION BY A DESIGNATED
REPRESENTATIVE OF THE CITY OF BOZEMAN.
2. THE GRANTOR, hereby grants the C.ity of Bozeman, a Temporary
Construction Permit, as shown on Exhibit A, attached hereto and
made a part hereof, for the period of one year or the duration of
the construction project, whichever is less.
3 . IT IS UNDERSTOOD AND AGREED THAT:
A. The Temporary Permit Area will be leveled and cleared of
any debris after construction and left in a good,
workmanlike condition.
B. The drive accesses will riot be blocked during business
hours and only temporarily as needed for construction at
other times. At least one drive access will be open at all
times. Drive accesses will be maintained in a condition
suitable for auto and truck traffic to the facility.
c. Existing landscaping and dr:iveways shall be returned to
like or better condition upon completion of the
construction.
The parties hereto have executed this agreement the day and year
as written below.
