COMMISSION RESOLUTION NO. 3908
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN,
MONTANA, CREATING A PAYBACK DISTRICT FOR SPECIAL IMPROVEMENT
DISTRICT NO. 684, IMPROVEMENTS TO DURSTON ROAD BETWEEN NORTH 19TH
AVENUE AND FOWLER AVENUE.
WHEREAS, the City of Bozeman owns and operates a street system within its corporate limits;
and
WHEREAS, the City Commission has created Special Improvement District No. 684, for
improvements to Durston Road between North 19th Avenue and Fowler Avenue; and
WHEREAS, the County Commission chose not to adopt a joint resolution and thereby allow
county properties to participate in the costs of said Special Improvement District No. 684; and
WHEREAS, numerous county properties will benefit directly from the improvements but will not
contribute to the costs of those improvements in the same manner that their city neighbors will; and
WHEREAS, the City Commission has committed City street impact fees to cover the maximum
cost of the improvements to Durston Road eligible for such funding; and
WHEREAS, City residents within the boundaries of the district will pay for these improvements at
the assessment rate of $0.186164 per square foot plus interest costs; and
WHEREAS, the benefited properties within the county did not participate in financing the original
cost of the street improvements;
WHEREAS, it is appropriate and equitable that, upon annexation, those county properties that
benefit from the improvements contribute to the costs of the improvements.
NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of Bozeman,
Montana, that a payback district be created for Special Improvement District No. 684.
Section 1
Boundaries of District. The limits and boundaries of the payback district are depicted on a map
attached as Exhibit A hereto (which is hereby incorporated herein and made a part hereof) and includes all

the properties within the boundaries of the payback district the legal description of which is contained in
Exhibit B hereto (which is hereby incorporated herein and made a part hereof), which boundaries are
designated and confirmed as the boundaries of the payback district. A listing of each of the properties in the
payback district is shown on Exhibit C hereto (which is hereby incorporated herein and made a part hereof).
Section 2
Payback Costs. Upon annexation, the City shall calculate the amount of the payback, at the
assessment rate of $0.186164 per square foot plus interest costs. The rate to be used in calculating the
interest costs shall be the interest rate for the bonds for Special Improvement District No. 684. If annexation
occurs during the term of the Special Improvement District, the City shall also calculate the amount that
would have been paid between November 2006 and the date of annexation. That amount shall be payable
on the effective date of the annexation; the remaining amount shall be spread over the remainder of the
nineteen years of Special Improvement District No. 684.
Section 3
Deposit of Payback Monies. All monies paid to the City under this payback district shall be
deposited in the City's Street Impact Fee Fund or other account as may be established by the City
Commission.
Section 4
Term of Payback District. The payback district shall be created immediately upon adoption of this
resolution and shall remain in effect for nineteen years from November 2006.
PASSED AND ADOPTED by the City Commission of the City of Bozeman, Montana, at a regular
session thereof held on the 24th day of April, 2006.
