Res 5052, CO 2 with FieldTurf USA for Turf Fields at Bozeman Sports ParkResolution 5052 – Additional TOP Funding for Bozeman Sports Park Commission Memorandum REPORT TO: Honorable Mayor and City Commission FROM: Addi Jadin – Parks Planner and Development Manager Mitch Overton – Director of Parks, Recreation and Cemetery SUBJECT: Resolution 5052 Authorizing the City Manager to Sign Change Order 2 with FieldTurf USA, Inc. for Perimeter Site Work Associated with Synthetic Turf Fields at Bozeman Sports Park in the Amount of $262,418.00 MEETING DATE: May 6, 2019 AGENDA ITEM TYPE: Consent RECOMMENDATION: Approve Resolution 5052 Authorizing the City Manager to Sign Change Order 2 with FieldTurf USA, Inc. for Perimeter Site Work Associated with Synthetic Turf Fields at Bozeman Sports Park in the Amount of $262,418.00 BACKGROUND: Resolution No. 4521 was unanimously approved by the Commission April 14, 2014 for the allocation of Trails, Open Space and Parks (TOP) bond funding in an amount not to exceed $7,500,000 for the acquisition of parkland and development of the Bozeman Sports Park Project. On February 12, 2018 Commission directed the City Manager to work with the Sports Parks Foundation to develop agreements to require the Sports Parks Foundation to pay an amount equal to the City’s debt payments on a loan of up to $1,700,000 to construct sports fields and related infrastructure, including purchase of synthetic turf, and allow for the Foundation to collect user fees for the Sports Park and operate the Sports Park through a user group or management agreement for Commission approval at future dates. On June 11, 2018 City Commission approved a Purchase Agreement for $779,323.66 and Construction Agreement with Field Turf for $796,396 for the purchase and installation of two synthetic turf fields at the Bozeman Sports Park for a total price of $1,575,719.66. Upon initial excavating and subsequent testing of soils it was determined that additional grading, a cement treatment base and woven liner should be added to ensure all tolerances are met for field performance, longevity and warranty. As such, the scope of services was amended to cover the costs. 265 Resolution 5052 – Additional TOP Funding for Bozeman Sports Park On October 1, 2018, the Commission unanimously approved Resolution 4946 authorizing the City Manager to sign Amendment No. 1 to the Construction Agreement with FieldTurf® for additional site work associated with construction of synthetic turf fields at the Bozeman Sports Park. At that time, the future completion of perimeter landscaping and paths around the synthetic turf fields was identified as an unresolved issue. With Phase 1 construction nearing completion, it is appropriate to utilize contingency funds and other unallocated funds to complete the portions of the perimeter site work as itemized in FieldTurf Change Order #2. UNRESOLVED ISSUES: None. ALTERNATIVES: Per Commission. FISCAL EFFECTS: The allocation of $262,418.00 is within the remaining balance of the Sports Park TOP fund. Change Order #2 Report compiled on: April 25, 2019 266 Resolution 5052 – Additional TOP Funding for Bozeman Sports Park COMMISSION RESOLUTION NO. 4757 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, TO AUTHORIZE ADDITIONAL FUNDING FROM THE 2012 TRAILS, OPEN SPACE AND PARKS BOND FUND FOR THE BICYCLE AND PATHWAY TO THE “M” AND DRINKING HORSE MOUNTAIN PROJECT WHEREAS, Resolution 4484 approved and authorized funding in the amount of $600,000 for the Bicycle and Pedestrian Pathway to the “M” and Drinking Horse Mountain project; and WHEREAS, Commission authorized the City Manager to enter into a Grant Match Agreement with the U.S. Department of Transportation’s Federal Land Access Program; and WHEREAS, the required federal National Environmental Policy Act public input process and associated surveys and investigations were completed in order to develop a preferred pathway alignment concept, which necessitated negotiations with five property owners along the pathway corridor to obtain easements or rights-of-way. WHEREAS, due to the inability to secure all of the necessary easements, a revised pathway alignment must be pursued; and WHEREAS, the project partners and staff recommend pursuing a design alternative which has an added cost of approximately $75,000. NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of Bozeman, Montana: 267 Resolution 5052 – Additional TOP Funding for Bozeman Sports Park Section 1 Funding / Authority. The Commission hereby authorizes additional funding in the amount of $75,000 from the balance of the 2012 Trails, Open Space and Parks Bond fund to cover the additional costs for design and construction of the project as recommended by staff. Section 2 Amendment to Resolution 4484. This resolution serves to amend Resolution 4484 as delineated in Section 1 above. WHEREAS, on June 11, 2018, the City Commission approved the “Construction Agreement” with FieldTurf® for installation of synthetic turf sports fields at the Bozeman Sports Park; and WHEREAS, on October 1, 2018, the Commission approved Resolution 4946 authorizing the City Manager to sign Amendment No. 1 to the Construction Agreement with FieldTurf® for additional site work associated with construction of synthetic turf fields at the Bozeman Sports Park; and WHEREAS, Section 7-5-4308, Montana Code Annotated, provides that any alterations or modifications of the specifications and/or plans of a contract be made by resolution; and WHEREAS, perimeter site work was identified within the original scope of work and funds remain available; NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of Bozeman, Montana, that the proposed modification to the contract between the City of Bozeman, a municipal corporation, and FieldTurf® as indicated in “Exhibit A” attached hereto, is hereby approved; the City Manager is hereby authorized and directed to execute the contract amendment for and on behalf of the City; and the City Clerk is authorized and directed to attest such signature. 269 PASSED, ADOPTED, AND APPROVED by the City Commission of the City of Bozeman, Montana, at a regular session thereof held on the 6th day of May, 2019. ___________________________________ CYNTHIA L.
