SUBJECT: Commission Resolution No. 5043 – Amending the City’s Annual Budget
for the Street Impact Fee Fund Appropriations for the Fiscal Year Ending
June 30, 2019 (FY19).

RECOMMENDATION: Approve Resolution No. 5043- Amending the City’s Annual
Budget for Street Impact Fee Fund Appropriations.
BACKGROUND:
We have an opportunity to obtain an easement for future improvements to the intersection at
Baxter/Cottonwood. This intersection is CIP project SIF086 planned for FY23. Part of the right-
of-way that we need is on the northeast corner of the intersection. The property owners were
approached to purchase the necessary easements in 2017. The property owners decided not to
accept our offer at that time and indicated that they would only accept an offer for the entire
property. The owners have since contacted us and indicated they are willing to sell easements
specifically for the areas needed for intersection improvements.
Our CIP includes $750,000 for right of way acquisition at the intersection in FY23 (CIP SIF143).

We are acquiring the necessary right of way on the southwest corner of the intersection with the
recent 160 acre annexation west of Cottonwood. We already have the right of way on the southeast
corner of the intersection with the Sports Park property. We will still need to acquire substantial
right of way on the northwest corner.
This budget amendment will allow us to purchase the needed right of way for the future
intersection for $184,150.
ALTERNATIVES: As suggested by the Commission.
FISCAL EFFECTS: The current budgeted spending in the Street Impact Fee Fund will increase
by a total of $184,150. The FY19 estimated ending cash balance in the Street Impact Fee Fund
will be decreased from $3,124,141 to $2,939,991. We have cash available due to changes in the
street reconstruction projects and timing.

RESOLUTION NO. 5043
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN,
MONTANA, AMENDING FISCAL YEAR 2019 (FY19) STREET IMPACT FEE FUND
BUDGET TO INCLUDE ADDITIONAL EXPENDITURES OF $184,150 FOR RIGHT OF
WAY ACQUISITION.
WHEREAS, the City Commission did, on the 25th day of June, 2018, after due and
proper legal notice, conduct a public hearing and adopt a municipal budget for Fiscal Year 2018-
2019 (Fiscal Year 2019); and
WHEREAS, the City Commission did, on the 6th day of May 2019, after due and proper
legal notice, conduct a public hearing on proposed amending the municipal budget.
NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of
Bozeman, Montana, to wit:
Section 1 – Appropriation Changes
The City Commission of the City of Bozeman, Montana, does hereby authorize the
following changes to expenditures in the Street Impact Fee Fund:
Additions: This project and amount is added to the FY19 budget.
Right of way acquisition $184,150
Total Appropriations Changes: $184,150

Section 2 – Use of Cash on Hand in the Street Impact Fee Fund
The increased appropriation will be funded with cash on hand in the Street Impact Fee
Fund.
Section 3
Pursuant to Section 7-6-4030, M.C.A., this resolution, upon its passage, shall be in full
force and effect on July 1, 2018.
Section 4
That should it be found by any court of competent jurisdiction that any section, clause,
portion, sentence, word, or phrase of this resolution is deemed to be contrary to any existing law
or regulations, that in this instance, it is the intent of the City Commission of the City of Bozeman,
Montana, that all other portions, sections, words, clauses, phrases, or paragraphs of this document
shall remain in full force and effect

PASSED, ADOPTED, AND APPROVED by the City Commission of the City of
