New Hyalite View Subdivision
AGENDA ITEM TYPE: Consent MEETING DATE: April 15, 2019
RECOMMENDATION: Authorize the City Manager to sign the Easement Agreement for
property needed to install and maintain overhead electric power lines in a City owned trail corridor adjacent to New Hyalite View Subdivision.
BACKGROUND: Northwestern Energy is requesting a 20 foot wide overhead electric
easement to provide for the relocation of an existing 50kV electric transmission line currently
located along the residential lots on Holly Drive and Maple Drive within the New Hyalite View Subdivision.
The primary reason for this request is to consolidate an electric distribution line as an under-
build with the transmission line in one easement area which will be along the south boundary of
the City of Bozeman open space property, where a distribution line currently exists that serves the residential lots along the north side of Holly Drive. For an illustration, please refer to the Exhibit "A" drawing attached to the easement.
The net effect of this relocation will clean up the residential area, while enabling NWE to better
operate both systems more efficiently going forward.

FISCAL EFFECTS: None ALTERNATIVES: As suggested by the City Commission.

OVERHEAD ELECTRIC POWERLINE EASEMENT
CITY OF BOZEMAN, a political subdivision of the State of Montana, of 111 South Grand Ave., Suite 203, Bozeman, MT 59715, as "Grantor", in consideration of $1.00 and other good and valuable consideration, in hand paid, the receipt of which is acknowledged, does grant and convey to NORTHWESTERN CORPORATION D/B/A NORTHWESTERN ENERGY, a Delaware corporation, of 11 East Park Street, Butte,
MT 59701, as "Grantee", and to its successors, assigns and apportionees, an overhead
easement twenty (20) feet wide, upon which to construct, operate, maintain, replace, upgrade, and remove overhead electric powerlines, communications systems, and necessary appurtenances, including any guy wires that may extend beyond the easement width, over, under, along and across that certain real property located in Gallatin County, Montana, and particularly described as follows:
An open space park area located within the New Hyalite View Subdivision of the
City of Bozeman and Gallatin County, Montana, being a rearrangement of Hyalite
View Subdivision and a portion of Western Union Addition in Bozeman,
Montana, and of a portion of Bellamy Place Suburb in Gallatin County, Montana
and other lands, and being a part of the E½SE¼ of Section 18 and the SW¼ of
Section 17, Township 2 South, Range 6 East, M.P.M.
For an illustration of the location of the overhead electric powerline easement
area see Exhibit “A” attached hereto and by this reference made a part hereof.
TOGETHER with reasonable right of access to and from the easement areas over
lands of the Grantor using existing roads and trails where practicable; the right to use and
keep the easement areas free and clear of any and all obstructions or structures, except
fences; and the right to clear and remove all timber, brush, or vegetation outside of the
easement areas that may, in the Grantee’s sole opinion, endanger the overhead
powerlines, communications systems, necessary appurtenances, or guy wires.
GRANTOR covenants with the Grantee that the Grantor is lawfully seized and
possessed of the real estate above-described, and that the Grantor has a good and lawful
right to convey it, or any part thereof.
