LAKES AT VALLEY WEST PHASE 5 & 6 PLANNED UNIT DEVELOPMENT FOR
PROPERTY LOCATED AT 5600 DURSTON ROAD, BOZEMAN, MONTANA
WHEREAS, the undersigned property owner acknowledges the receipt of a planned unit
development to allow seventy nine (79) residential lots with twenty(20) accessary dwelling units
on twenty of the lots, nine(9) common open space lots, one (1)park lot and related site
improvements at the southwest corner of Cattail Street and Blackbird Drive, City of Bozeman,
Montana; and
WHEREAS, the use is to be located on property that is legally described as Lot R213 of
Lakes at Valley West Subdivision Phase 4, located in the Northwest One-Quarter (NW '/),
Section 9, Township Two South(T2S), Range Five East(R5E), P.M.M., City of Bozeman,
Gallatin County, Montana; and
WHEREAS, the Planned Unit Development(PUD) is contained within the City of
Bozeman Department of Community Development's subdivision application 18504 and zoning
applications 18503; and
WHEREAS, the use is to be located on property that is legally zoned as R-1 (Residential
Low Density District) zoning district; and
WHEREAS, the Planned Unit Development was granted relaxations from the zoning
requirements of the Unified Development Code and the requirements,of the-£R-1 zoning district; -
and
WHEREAS, the Planned Unit Development is subject to the following conditions of
approval and code provisions:
1. The final PUD plan shall be submitted,reviewed, and approved prior to approval of the
final plat.
CONDITIONS OF APPROVAL FOR A CONDITIONAL USE PERMIT APPLICATION
2. The applicant is advised that unmet code provisions, or code provisions that are not
specifically listed as conditions of approval, does not, in any way, create a waiver or
other relaxation of the lawful requirements of the Bozeman Municipal Code or state law.
3. The applicant shall submit with the application for Final PUD Plan review and approval,
a written narrative stating how they have responded to each of these comments. This
narrative shall be in sufficient detail to direct the reviewer to the appropriate plat,plan,
sheet, note, covenant, etc. in the submittal.
4. The final plan submittal shall identify the uses to be allowed on each proposed lot in the
design guidelines and associated development standards as was done with Phases 1-4.
5. No property may be removed from the covenants without written approval of the City of
Bozeman.
6. The City of Bozeman has relied upon the overall design standards required as part of the
planned unit development application. The design standards may not be altered without
consent of the City.
Code Requirements Requiring Plan Changes:
None.
NOW, THEREFORE,BE IT HEREBY KNOWN,that the above-noted conditions of
approval and code provisions for the Planned Unit Development shall be binding upon the
undersigned owner of the subject property, and successors or assigns, as long as the use remains
at the property addressed at 5600 Durston Road.
