Res 5004, Intent to Adopt the 2019 DBIP under the City Growth Policy Commission Memorandum REPORT TO: Mayor and City Commission FROM: Martin Matsen, Planning Director Andrea Surratt, City Manager SUBJECT: Commission Resolution No. 5004 MEETING DATE: Monday, March 25, 2019 AGENDA ITEM TYPE: Consent RECOMMENDATION: Approve Commission Resolution No. 5004 declaring the City Commission’s intent to consider adoption and integration of the “2019 Downtown Bozeman Improvement Plan” as a neighborhood plan under the City of Bozeman growth policy and set a public hearing date of April 15, 2019. BACKGROUND: The City of Bozeman has had an adopted growth policy since 1958. The most recent growth policy was adopted on June 1, 2009, known as the Bozeman Community Plan (BCP). The growth policy allows for the development of “neighborhood plans” for a sub- sector of the Bozeman community. The City of Bozeman partnered with the Downtown Bozeman Partnership and consultants, Agency Landscape and Planning, Groundprint, Intrinsik Architecture, and Leland Consulting, in the update to the downtown Bozeman neighborhood plan entitled “2019 Downtown Bozeman Improvement Plan”. The Planning Board conducted a public hearing on the draft downtown Bozeman neighborhood plan. At their March 5, 2019 meeting, the Planning Board voted unanimously to recommend to the City Commission approval of the draft plan with staff recommended corrections. The City Commission is required to pass a resolution of intent to amend a growth policy and conduct at least one public hearing before taking action. The resolution of intent states the intent to consider the revised growth policy and sets a date for the public hearing. An adopted Planning Board resolution and minutes, as well as any submitted public comments, will be provided to the City Commission prior to the public hearing. A draft resolution and minutes are provided with this memo. A draft of the downtown Bozeman neighborhood plan will be provided once the public hearing is set. FISCAL EFFECTS: Budgeted funds will be used to advertise the public hearing. ALTERNATIVES: As suggested by the City Commission. Attachments: Draft resolution and Planning Board minutes Report compiled on March 31, 2019 95 Page 1 of 3 RESOLUTION NO. 5004 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, STATING THEIR INTENT TO ADOPT AND INTEGRATE THE “2019 DOWNTOWN BOZEMAN IMPROVEMENT PLAN” AS A NEIGHBORHOOD PLAN UNDER THE CITY GROWTH POLICY WHEREAS, the City of Bozeman has had a comprehensive plan (growth policy) since 1958; and WHEREAS, the City of Bozeman adopted its most recent growth policy known as the Bozeman Community Plan (BCP) through Resolution 4163 on June 1, 2009; and WHEREAS, the BCP allows for the development of “neighborhood plans” for a sub-sector of the Bozeman community; and WHEREAS, the Downtown Bozeman Improvement Plan Area and 2009 Downtown Bozeman Improvement Plan were established with the approval of Resolution No. 4230 on January 25, 2010; and WHEREAS, the City of Bozeman partnered with the Downtown Bozeman Partnership and consultants, Agency Landscape and Planning, Groundprint, Intrinsik Architecture, and Leland Consulting, in the update to the downtown Bozeman neighborhood plan entitled “2019 Downtown Bozeman Improvement Plan”; and WHEREAS, the City of Bozeman Planning Board conducted a public hearing on the “2019 Downtown Bozeman Improvement Plan” on March 5, 2019; and 96 Resolution 5004, Intent to Adopt the 2019 Downtown Bozeman Improvement Plan as a Growth Policy Component Page 2 of 3 WHEREAS, having considered the draft plan and receiving four public comment letters and one oral testimony, the Planning Board made a recommendation to the Bozeman City Commission that they approve the plan as submitted with contingencies necessary to complete application processing and the correction to the text submitted by staff; and WHEREAS, in accordance with 76-1-602, MCA, the City Commission must conduct a public hearing prior to taking any action to adopt or revise a growth policy; NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of Bozeman, Montana, that: Section 1 In accordance with the requirements of Section 76-1-604 MCA, the intent to adopt and integrate the “2019 Downtown Bozeman Improvement Plan” as a neighborhood plan under the City growth policy is hereby stated, for the purpose of entirely replacing the 2009 Downtown Bozeman Improvement Plan. Action Items 1. 07:18:16 PM (00:14:05) Bridger Vale Subdivision Preliminary Plat 17231 (Krueger) A Preliminary Plat application to allow the subdivision of 6.48 acres into twenty townhome lots, one 99 commercial lot, one city park lot, one open space lot with an associated street and alley.
