Nelson Meadows Subdivision Preliminary Application - SUPPLEMENTAL MATERIALS (2) To: Mayor and City Commissioners Fr: Tom Rogers,Senior Planner Griffin Nielsen, Engineer Re: Conditions for Nelson Meadows Major Subdivision Preliminary Plat Beginning on Friday, February 1, 2019 and continuing today, several members of the community have submitted public comment. In addition,the applicant's legal counsel submitted a public comment today specifically requesting adjustments to the staff suggested conditions of approval. We provide this memorandum to provide the Commission staff suggestions regarding the comments received. Specifically, we provide a suggested additional condition of approval to address comments related to the width of the share use path along the southern border of the development. In addition, we also provide suggested conditions of approval in response to the letter received today from Susan Swimley on behalf of the applicant. This memorandum does not explain the justification for the adjustments to the conditions of approval. Given the short time frame we provide this memorandum to simply provide the language for the adjusted conditions.We will explain the rationale for the adjustment orally on the record. Remove and Replace Condition of Approval No.42 with the following: 42. The applicant must provide a cash-in-lieu of infrastructure payment for their proportional share of the water main to be constructed under Interstate 90 (using as a basis for the proportional costs the City's minimum water main size). In the alternative,and only if the City does not finalize plans for construction of the water main under Interstate 90,the City Engineer may authorize the Subdivider to construct an alternative secondary water system connection. Remove and Replace Engineering Provision 6(a)(iii)with the following: 6.a.iii) The Water Facility Plan calls for a water main connection from Davis Lane north under Interstate- 90 to daylight adjacent to the proposed future Davis Lane wastewater lift station to provide the required looped water distribution. The proposed subdivision must connect to this future water main connection. The Developer recognizes the City plans to construct the water main with CIP Project No.WIF25.See Condition of Approval No.42. New Conditions of Approval: 43. Cash-in-lieu of water right. The transfer of water rights or the payment of cash-in-lieu (CIL) of water rights must be provided prior to final plat approval. (see Engineering Provision 8(a)). 44. The Type-I multi-use path adjacent to Frontage Road must be constructed to a minimum of 10 foot asphalt pathway pursuant to adopted Engineering specifications prior to final plat approval. 45. The applicant must provide and file with the County Clerk and Recorder's office executed Waivers of Right to Protest Creation of Special Improvement Districts (SID's) on Lots 4, 5, and 6 of Block 3, Lots 2 and 3 of Block 5, and Lot 1 of Block 6 for the following: a. Street improvements to the local street along the northern property boundary of the Nelson Meadows Subdivision, including paving, curb/gutter, sidewalk, and storm drainage The document filed must specify that in the event an SID is not utilized for the completion of these improvements,the developer agrees to participate in an alternate financing method for the completion of said improvements on a fair share, proportionate basis as determined by square footage of property, taxable valuation of the property,traffic contribution from the development, or a combination thereof. The applicant must provide a copy of the filed SID waiver with the final plat.
