The Property is also referred to as Phase 1 of the Cannery District Master Site Plan. Subparagraph 3(a)(i)of the Agreement provides that the lands in Phase lshall be annexed into the City no later than one(1)year after the date when all existing buildings in Phase 1 have been restored and renovated by Landowner or its successors,and,subsequent to restoration and renovation,ninety-five percent(95%) of the rentable space therein has either been leased and occupied by Landowner's tenants or sold to third parties unrelated to Landowner.Pursuant to the Agreement, annexation of the Property is self-operating, and under Subparagraph 3(a)(i)thereof,the effective date of annexation is January 17,2019.
