AGREEMENT
THIS IS AN AGREEMENT between the City of Bozeman, Montana, a mu-
nicipal corporation, hereinafter referred to as the "City, " and the Bozeman
High School District and School District No. 7 of Montana, hereinafter referred
to as the "District," for the purpose of providing by the City pool facilities at
the Swim Center to the District for instructional purposes during the 1990/91
and 1991/92 school years, and the setting of the fee to be paid by the District
to the City.
Section 1
In accordance with the Swim Center I nterlocal Agreement between the
City and the District, the City shall provide to the District the Swim Center
facilities for instructional purposes during the 1990/91 and 1991/92 school
years. The City will provide the School District with shared use of the Swim
Center from 6:30 to 8:00 a.m. and 3:30 to 5: 15 p.m. for the Swim Team.
Classes will be from 8:30 a.m. to 12 noon and 1 :00 to 3:30 p.m. The program
will include 2nd, 3rd, 5th, 7th through 10th grades, Advanced P.E., Adaptive,
Weight Lifting and a staff pass for staff and family members. The contract
amount will be paid over a 10-month period in each of the two school years.
The City will allow schedul ing of School District activities from 12 noon to 1: 00
p.m. that are compatible with lap swimming. The City wi II schedule, without
additional charge, one meet per year on a Saturday. If additional swim meets
are scheduled on Saturdays, the fee will be $30.00 per hour. All scheduling of
programs or classes will be done through the Pool Manager.

Section 2
During School Year 1990/91, the District shall pay to the City the sum
of $42,286.00, payable in ten equal monthly payments of $4,286.00 each month
beginning September 1 , 1990 and ending June 1 , 1991. During School Year
1991/92, the District shall pay to the City the sum of $43,555.00, payable in
ten equal monthly payments of $4,355.00 each month beginning September 1 .
1991 and ending June 1, 1992.
Section 3
During this Agreement, the City will provide Swim Center Adult Passes
for all school district trustees and staff members at an annual minimal fee of $10
each; annual family pass, $45. The passes are good from the beginning day of
school until the last day of school.

the School District for usage of the Swim Center during Schoof Years
1990/91 and 1991/92.

to your discussions with Recreation Superintendent Sue Harkin. If you
have any questions or concerns about the agreement, please contact me.
After you have signed both copies, please return them to me. The City
Manager and I will then execute them and return one completed copy to
you for your files.

RE: Swim Center Contract
Fees for use of the Bozeman Swim Center have remained the same,
$39,520, since the 1986 contract. In 1986 the fees were
increased "'-%, that was a 1% increase annually from 1982-1986.
The 1986 increase of fees was requested and granted due to the
increase in operating costs and liability insurance increases.
The city of Bozeman has been providing swimming lessons for the
Bozeman School District based upon the 1984-85 school enrollment.
As you are well aware there has been a gradual increase in the
number of elementary students since 1985. The increase in
students has caused the City to increase the number of certified
swimming instructors for the elementary swimming classes.
Finding enough qualified instructors has been very difficult.
Below are the difference as to the number of required city
instructors hours in 198"'--85 compared to 1989-90. The instruct.or
student ratio for elementary aquatic lessons remains the same at
1-10.

Due to the increase in staff salaries and the incidentals costs
occurred, the City of Bozeman request a 1% annual increase for a
total of "'-% increase. In addition, a 3% increase for additional
students is requested. The City is requesting a 7% increase for
90-91 over 1986-87 figures. The contract amount would be
$42,286. The 1991-92 contract would reflect a 3% increase to
$"'-3,555.

The Bozeman School District #7 will have use of the Bozeman
Swim Center during the school year. The Swim Center will be used
as scheduled by the pool manager for instructional purposes from
8:30- a.m. - 12:00 p.m. and from 1:00 p.m. - 3:30 p.m. The High
School Swim Team will use the pool from 6:30 ~ 8:00 a.m. and from
3:30 - 5:15 p.m.

The specific dates and times will be printed on a Swim Center I
School District schedule within the first few weeks of each

All School District Instructors teaching in the Swim Center must
have a Lifeguard Certificate and Water Safety Instructors
Certificate.
The Junior and Senior High should make every effort possible to
secure WSI certified substitutes when regular school district
members are ill.
