AGREEMENT
THIS IS AN AGREEMENT between the City of Bozeman, Montana, a
municipal corporation, hereinafter referred to as the "City," and
Bozeman School District No.7 of Montana, hereinafter referred to
as the "District," for the purpose of providing use of the
Bozeman Swim Center during 1998-1999, 1999-2000 and 2000-2001
school years, and the setting of the fee to be paid by the
District to the City.
Section 1
In accordance with the Swim Center Interlocal Agreement
between the City and the District, the City shall provide to the
District the Swim Center facilities for instructional purposes
during 1998-1999, 1999-2000 and 2000-2001 school years. The City
will provide the District with shared use of the pool for classes
from 8:30 a.m. to 12:00 p.m. and 1:00 p.m. to 3:30 p.m. according
to appendix A. The program will include swim lessons for grades,
9-12. The City will provide the District use of the pool for
high school make up according to appendix B. The City will
provide the District with shared use of the Swim Center for the
High School Swim Team according to appendix c. Pool hours for
1999-2000 and 2000-2001 will be arranged between the High School
Instructors and the Swim Center management and submitted to the
District.

Additional School District classes/programs may use the pool
during the District's scheduled pool time by scheduling through
the pool manager. Athletic teams may use the pool during
recreation pool hours at the youth special group rate of $1.75
per student. Teams will be billed separately. Any changes to the
pool schedule must be cleared through the pool manager. Summary
of the pool hours and fee rates are in appendix A.
Section 2
The City will provide one (1 ) American Red Cross Water
Safety Instructor for each high school class scheduled. The City
will provide one (1 ) American Red Cross Lifeguard to guard the
pool.
Section 3
When a School District teacher is ill, the District
shall try to secure a certified Water Safety Instructor as a
substitute teacher.
Section 4
During School Year 1998-1999, the District shall
pay to the City the sum of $38,429.25 payable in ten equal
monthly payments of $3,842.93 each month beginning September 1,
1998 and ending June 1,1999. During the school years 1999-2000
and 2000-2001, beginning September 1, the District shall pay
to the City the monthly amount from the previous year until that
year's appendixes A, B, & C are established. The monthly amount
shall then be adjusted for the remaining monthly payments through
June I. Fee rates for 1998-1999, 1999-2000 and 2000-2001 are in
Appendix D.

Section 5

During the 1998-1999 school year, the City will offer Swim Center
Passes for School District Trustees and staff members at an
individual pass fee of $10, or a family pass fee of $45. During
the 1999-2000 and 2000-2001 the individual pass fee will be $15
and the family pass fee $50. The passes are good from September
1 through August 31, except when the pool is closed for
maintenance and repairs. The fee shall be $4,000, which shall be
included in the overall contract amount.
Section 6
The District shall provide plowing of the designated Swim Center
parking area in accordance with the School District's plowing
schedule.
Section 7
The City and the District shall not discriminate on the
basis of race, color, creed, religion, sex, age, marital status,
native origin, or disability, in employment or the provision of
service. The District shall be responsible to insure
accessibility of it's programs through notification of
opportunity under the Americans With Disabilities Act.

APPENDIX A
BOZEMAN HIGH SCHOOL CLASS INSTRUCTION POOL USAGE 1998-1999
Class instruction will be between 8:30 a.m.-12:00 p.m. and
1:00 p.m.-3:30 p.m., Monday-Friday. The Swim Center will provide
one (1 ) American Red Cross Water Safety Instructor per class and
one (1 ) American Red Cross certified Lifeguard per class. The

APPENDIX B
HIGH SCHOOL MAKE UP POOL USAGE 1998-1999
Make up will be held on Tuesday, Wednesday, and Thursday from
7:15 a.m. - 7:45 a.m. One (1) American Red Cross certified
Lifeguard will be provided by the Swim Center staff. High School
staff must monitor and supervise lap make-up swims.
