AGREEMENT
THIS IS AN AGREEMENT between the City of Bozeman, Montana, a
municipal corporation, hereinafter referred to as the "City," and
Bozeman School District No.7 of Montana, hereinafter referred to
as the "District," for the purpose of providing use of the Bozeman
Swim Center during 1996/97 school year, and the setting of the fee
to be paid by the District to the City.
Section 1
In accordance with the Swim Center Interlocal Agreement
between the City and the District, the City shall provide to the
District the Swim Center facilities for instructional purposes
during 1996/97 school year. The City will provide the District
with shared use of the pool for classes from 8:30 a.m. to
12:00 p.m. and 1:00 p.m. to 3:30 p.m. according to appendix A. The
program will include swim lessons for grades 9-12. The City will
provide the District use of the pool for high school make up
Tuesday and Thursday 7:30 a.m. to 7:45 a.m., Friday from 7:15 a.m.
to 7:30 a.m. according to appendix B. The City will provide the
District with shared use of the Swim Center for the High School
Swim Team, Tuesday, Wednesday, and Thursday from 6:00 a.m. to
7:45 a.m. Monday, Tuesday, Thursday, and Friday from 3:45 p.m. to
5:30 p.m., and Saturday from 7:00 a.m~ to 9:00 a.m. according to
appendix c.

Additional School District classes/programs may use the pool during
the District's scheduled pool time by scheduling through the pool
manager. Athletic teams may use the pool during recreation pool
hours at the youth special group rate of $1.00 per student. Teams
will be billed separately. Any chang~s to the pool schedule must be
cleared through the pool manager. Summary of the pool hours and fee
rates are enclosed in appendix D.
Section 2
The City will provide one (1) American Red Cross Water Safety
Instructor for each high school class scheduled. The City will
provide one (1) American Red Cross Lifeguard to guard the pool.
-Section 3
When a School District teacher is ill, the District
shall try to secure a certified Water Safety Instructor as a
substitute teacher.
Section 4
During School Year 1996/97, the District shall
pay to the City the sum of $ 41,366.51, payable in ten equal

monthly payments of $ 4,136.65 each month beginning September 1,
1996 and ending June 1, 1997.

Section 5
During the 1996-1997 school ,year, the City will offer Swim Center
Passes for School District Trustees and staff members at an
individual pass fee of $10, or a family pass fee of $45.
The passes are good from September 1,1996, through August 31, 1997,
except when the pool is closed for maintenance and repairs. The
City will provide the District on June I, 1997, a list of School
District Swim Center Pass holders and a statement. Passes sold
after June I, 1997, will be added to the 1997-1998 list. The
District will pay the Clty the difference between what the District
employee pays and the cost of the pass. The amount shall not exceed
$4,000.00. The payment will be due July 30, 1997.
Section 6
The District shall provide plowing of the designated Swim Center
parking area in accordance with the School District's plowing
schedule.
Section 7
The City and the District shall not discriminate on the
basis of race, color, creed, religion, sex, age, marital status,
native origin, or disability, in employment or the provision of
service. The District shall be responsible to insure
accessibility of it's programs through notification of opportunity
under the Americans With Disabilities Act.

APPENDIX A
BOZEMAN HIGH SCHOOL CLASS INSTRUCTION POOL USAGE 1996-1997
Class instruction will be between 8:30 a.m. - 12:00 noon and 1:00
p.m. - 3:30 p.m., Monday through Friday. The Swim Center will
provide one (1) American Red Cross certified Instructor per class.
The program will include swim lessons for grades 9-12. One (1 )
American Red Cross certified Lifeguard will be provided by the Swim
Center staff. The School District will provide one (1) instructor
per class.

APPENDIX B
HIGH SCHOOL MARE UP POOL USAGE 1996-1997
Make up will be held from 7:30 a.m. - 7:45 a.m. Tuesday and
Thursday and 7:15 a.m. - 7:30 a.m. on Friday. One (1) American Red
Cross certified Lifeguard will be provided by the Swim Center
staff. High School staff must monitor and supervise lap make-up
swims.

RE: Billing to Bozeman School District ~7 for Swim Center use
The Bozeman School District will pay a total of $41,366.51 this
year. As you will notice, the contract was just signed today.
Please bill the Bozeman School District for the months of September
through January at this time and start the monthly billings on
February 1st. As you will note on the contract, the monthly
billings will continue the 1st of each month through June 1, 1997.
