SEWER LINE REIMBURSEMENT AGREEMENT
THIS AGREEMENT, made this ~ day of October , 1993, between CITY
OF BOZEMAN. MONT ANA, hereinafter referred to as "City", whose address is 35
North Bozeman, Carnegie Building, Bozeman, MT 59715, and WAL-MART STORES.
IN C. , hereinafter referred to as "Wal-Mart" , whose address is 702 S.W. 8th
Street, Bentonville, Arkansas 72716.
WITNESSETH THAT:
1. Wal-Mart Property: Wal-Mart is the owner of a property located at the
southeast corner of Interstate 90 and 7th Avenue; and
2. Replacement of Sewer Line: Wal-Mart desires to replace the existing
sewer line with a new 21" sewer line in accordance with Plans and Specifications
prepared by Civil Land Consultants and previously approved by the City,
hereinafter referred to as the "Project.
NOW, THEREFORE, for and in consideration of the sums paid hereunder and
the mutual covenants and agreements of the parties hereto, it is agreed that:
1. Within thirty (30) days of Wal-Mart's completion of the Project and the
City's approval and acceptance of the Project, the City shall reimburse Wal-Mart
(1) $30,000.00 or (2) 25% of the actual cost of constructing the Project, whichever
is less.
IN WITNESS WHEREOF, the parties have hereunto subscribed their names and
seals as of the date stated above.
