HomeMy WebLinkAbout86- Bozeman and Belgrade to provide Police Communication and Information Services " ~ . , AGREEMENT TO PROVIDE POLICE COMMUNICATION AND INFORMATION SERVICES AGREE11ENT MADE and entered into 011 ,Tuly 1 , 1986, bet\veen t.he City of Bozeman, a municipal corporation and political subdivision of the State of Montana, and the City of Be],qrade, a municipal corporation ana political subdivision of the State of r'10ntana. RECITAlJS A. The City of Bozeman through its Police Department, operates, and maintains a control terminal for the Law Enforcement Tele- communications System (L.E.T.S.) and other police communication equipment. B. The City of Belgrade's Police Department desires to utilize the services of Bozeman's L.E.T.S. control terminal and police communication network and therefore desires to enter into an agreement with the City of Bozeman for the use of the L.E.T.S. control t:crmina] and police communication system. C. The City of Bozeman is willing to enter into a one-year trial service agreement with the City of Belgrade to provide access to the L.E.T.S. control terminal and to provide police communication services. SECTION I. The City of Bozeman through its Police Department hereby agrees to provide police communication I..E.T.S. services to the City of Belgrade's Police Department for a one-year period of time commencing July 1, 1986, with the understanding that at the end of the one-year period of time, both parties hereby agree to re-evaluate this agreement as to the feasibility of continued use of the services by the City of Belgrade's Police Department and as to the ability of the City of Bozeman's Police Department to provide said services. The City of Bozeman and the Bozeman Police DepartMPnt on or he fore May 15, 1987, shall notify the City of Bplgrade and the Belgrade Police Department of the feasibility to continue its performance hereunder for an additional one-year period of time, subject to renegotiation of the terms taki~g into consideration -1- . . . . .' . . the administrativ~ costs, time and unanticipated contingencies incurred by the City of Bozeman and its police department during the trial period. On or before June 5, 1987, the City of Belgrade and its police depart~ent shall notify the City of Bozeman and its police department of its decision to continue the relationship or not. SECTION II. The City of Bozeman's Police Department hereby agrees to appropriately route criminal history record information, ~ereinafter called CHPI, and the City of Belgrade's Police Department agrees to assure the City of Bozeman and the I..E.T.S. network that requests for CHRI are for legitimate law enforcement/criminal justice purposes. SECTION III. The City of Belgrade's Police Department agrees to comply with the National L.E.T.S. policies and procedures for the interstate exchange of CRRI as well as vlith the U.S. Department of Justice's and the State of Montana's rules and regulations as they relate to completeness, accuracy, and dissemination af CHPI and any rules, policies, and procedures hereinafter approved by the National L.E.T.S. and the u.s. Department of .Justice. Said policies, procedures, rules and regulations are hereby incorporated by reference into this agreement as though fully set forth herein. SECTION IV. The City of Belgrade's Police Department hereby agrees to the familiarize itself, its officers and employees with the rules and regulations of the Department of Justice and the National J....E.'J'.S. rules, ,. . and procedures, and laws of the State of pO...lC18S MontanCl in order to comply with Section III of this agreement. SECTION V. The City of Bozeman's Police Department reserves the right to immediately suspend routing CHRI data to and from the City of Belgrade'~ Police Department when either the security or dissemination requirements approved by the National L.E.T.S. are violated. III III . 1- , " . . the routing of CHRI in such instances upon receipt of satisfactory assurances that such violations have been corrected. SECTION VI. The City of Belgrade and the Belgrade Police Depar~ment hereby agree to indemnify and save harmless ~he City of Bozeman, the Bozeman Police Department and the L.E.T.S. network, officers and employees, from and against any and all claims, demands, actions, suits, and proceedings by others; against all liability to others, inclnding but not limi t.ea to any 1 iahili ty for damages by reason of or arising out of any false arrest or imprisonment or any cause of action whatsoever, and against any loss, cost, expense, and damages resulting therefrom, arising out of or involving any negligence on the part of the City of Belgrade and the Belgrade Police Department in the exercise or enjoyment of this agreement. SECTION VII. The City of Belgrade shall pay to the City of Bozeman the sum of One Hundred Dollars ($100.00) per week for the services herein provided. Box 268 Belgrade, Montana 59714 Dear Barb: This letter is to serve as confirmation of a one-year extension of the agreement dated July 1, 1986 and entered into by the City of Bozeman and the City of Belgrade. Under said agreement, the City of Bozeman Police Department provides dispatch and communications services for the City of Belgrade Police Department at a cost of $100.00 per week. All of the conditions set forth in the original agreement shall remain in full force and effect during this one-year period, from July 1, 1987 through June 30, 1988. Sincerely, ~a:!~ ROBIN L. Box 268 Belgrade, Montana 59714 Dear Mark: This letter is to serve as confirmation of a six-month extension of the agreement dated July 1, 1986, entered into by the City of Bozeman and the City of Belgrade. As you will note, that agreement was extended for a one-year period through a letter dated September 28, 1987. Under this agreement, the City of Bozeman Police Depart- ment provides dispatch and communications services for the City of Belgrade Police Department at a cost of $100.00 per week. This six-month extension of our agreement has been provided to allow your City an adequate amount of time to consider the pos- sibility of utilizing the Gallatin County Sheriff's Department dispatch facilities rather than ours. If you choose to change dispatch ser- vices, please give us a thirty (30) day written notice. I f you choose to retain our services, please let us know as soon as possible so that we can renew the contract without a lapse in service to you. All of the conditions set forth in the original agreement shall remain in full force and effect during this six-month period, from July 1, 1988 through December 31, 1988. Sincerely, ~oI~ ROBIN L.
