LETTER OF UNDERSTANDING
The Rae Fire Department seeks the use of a City of Bozeman owned fire hydrant located
on Baxter Lane between Simmental and North 19th Avenue for fire suppression activities at 75
Rawhide Ridge. The owner of the property at 75 Rawhide Ridge benefits by the provision of
available hydrant, water, and water system services to such property.
The following is understood and agreed to:
I. The City of Bozeman shall allow the Rae Fire Department use of its hydrants, water,
and water system located on Baxter Lane between Simmental and North 19th Avenue, during
construction activities and as necessary thereafter for fire suppression for the property located at
75 Rawhide Ridge, and for reasonable training on the use of hydrants in fire suppression. Rae Fire
Department shall not be charged for such use.
2. The City will indemnify and hold harmless the Rae Fire Department from and against
any suit, cause of action, claim, cost or obligation with respect to any damages alleged to have been
caused by Rae Fire Department's use of the City's hydrants, water, and water system during the
term of this agreement. Nothing herein obligates the City to indemnify Rae Fire Department for
any damages that are the result of Rae Fire Department's negligent acts or willful misconduct.
3. This indemnity will extend from the date of this agreement through all phases of
construction of the Keller Supply Project at 75 Rawhide Ridge, and after occupancy of said project,
until terminated as described below.
4. The use of the City's hydrants, water, and water system, and this indemnity, shall
terminate upon the annexation of the property at 75 Rawhide Ridge into the City of Bozeman, or
the assumption of fire service to the property by the City of Bozeman, or by mutual agreement of
the City of Bozeman and Rae Fire Department, whichever first occurs.
