I , MASTER MUTUAL AID AGREEMENT AMONG INCORPORATED CITIES OF THE STATE OF MONTANA WHEREAS, each incorporated city of the State of Montana is subject to natural and manmade disasters, which could overwhelm its resources; and WHEREAS, incorporated cities have equipment and personnel for disaster response; and WHEREAS, it is in the public interest that a mutual aid agreement is adopted to provide for mutual assistance in a disaster or emergency; and . WHEREAS, a mutual aid agreement is authorized by Montana Code Annotated, Section 10-3-202. NOW, THEREFORE, be it resolved that: ..-. I REQUEST FOR ASSISTANCE The chief elected official or a designee is authorized to request assistance from any party to this agreement if local resources must be augmented in a disaster or emergency. II RESPONSE TO REQUEST The official receiving the request shall: A. Determine if enough resources are available to respond. B. Determine which resources will be sent according to the mutual aid agreement. C. Record dispatched resources and expenses. D. The responding city is responsible to deliver its resources when appropriate. III COMMAND RESPONSIBILITY AT EMERGENCY SCENE The Incident Commander of the requesting city will be in charge of the responding city's resources. IV LIABILITY Each city hereto agrees to assume responsibility for liabilities arising out of the actions of its own personnel. V RETURN OF RESOURCES Resources of the responding city shall be released if no longer needed or upon demand by the responding city. .. , ; VI SUPPLEMENTAL RESOURCES A resource list will be provided by all cities who sign this agreement. The responding city may have its resources supplemented by other cities in this agreement to provide for public protection. VII INSURANCE Each city must maintain appropriate insurance coverage of its resources and personnel which may be requested for mutual aid assistance. Proof of coverage must be submitted . to the city attorney of the cities entering into this agreement. This , verification is MANDATORY before the agreement is signed. VIII COMPENSATION Unless the cities enter into a separate agreement compensation shall be as follows: A. The responding city will be reimbursed for equipment maintenance costs directly related to emergency support operations. These costs include fuel and damaged equipment not covered by city insurance. B. The responding city will be reimbursed for all personnel costs, including benefits, directly related to the emergency support operation. C. The responding city will be reimbursed for materials used in the operation of the emergency support. D. Payment will be made when each emergency operation terminates or at a later date if agreed upon or provided by law. All requests for compensation must be in writing with an appropriate accounting and documentation. E. The requesting city will provide food and shelter to the responding city's personnel. IX TERMINATION This agreement shall remain in full force and effect from this date forward unless terminated in writing by either party. X AGREEMENT NOT EXCLUSIVE This agreement is not intended to be exclusive between the participating cities; which may enter into other mutual aid agreements. ;.'~ IN WITNESS WHEREOF, the following cities have signed and attested to this Agreement. The enclm;ed agreement was developed by the cities of Billings 1 Great Falls and Helena. The attorneys from these cities agreed that it meets the requirements of State law.
