A G R E E ME N T
THIS AGREEMENT~ made and entered into this 12th day of
September t A.D., 1962, by and between THOMPSON HEREFORD RANCHES,
INC." a Montana Corporation, with its principal place of business at Bozeman,
Montana,. Party of the First Partl and CITY OF BOZEMAN, a municipal corporation
of the State of Montana, the Party of the Second Part;
WITNESSETH:
That the Party of the First Part is the owner of the following described

real estatE: situated in the City of Bozemanf'~ County of Gallatin, State of Montana,
to-wit:
All that portion of the West half (W~) of Section Eighteen (18),
Township Two (2) South, Range Six (6) East, M.P.M., County
of Gallatin, State of Montana, more particularly de scribed as
follows:
Beginning a.t the Southeast Corner of Butte Addition to the City
of Bozeman, County of Gallatin, State of Montana I thence Easterly
along the East-West center-line of said Section Eighteen (18) to
the center of said Section Eighteen (18); thence South 0027 '10"
East 4r214.23 feet to a point on the Northerly boundary of Spring
Creek Road, which point is the beginning of circular cur\e to the
right with a radius of 758.06 feet; thence along said curve a
distance of 734.22 feet through a central angle of 55029'40" to
a point on the Northerly boundary of said Spring Creek Road;
thence North 17 038' West 166.60 feet to a point on the Northerly
boundary of said Spring Creek Road, which point is the beginning
of a circular curve to the left with a radius of 566.67 feet; thence
along said curve a distance of 328.90 feet through a central angle
of 33015'20" to a point on the Northerly boundary of said Spring
Creek Road; thenoe South 78030' West a distance of 123.80 feet
to a point on the Southerly boundary of said Spring Creek Road;
thence South 16 0010' West a distance of 986.31 feet to a point;
thence South 11 045'30" West a distance of 77.48 feet to a point;
thence South 07021' West a distance of 222.17 feet to a point on
the Southerly boundary of said Section Eighteen (18); thence North
89024' West a distance of 1,320.12 feet to the Southwest corner
of said Section Eighteen (18); thence North 00-1' West a distance
of 1,465.07 feet to a point along the Southerly boundary of the
Milwaukee right-of-way; thence North 30016' East a distance of
I,. 353.60 feet along said Southerly right-of-way to a point on the
South line of said Butte Addition to the City of Bozeman, County
of Gallatin, State of Montana; thence East 245.95 feet to the
point of beginning;
That the Party of the First Part desires to plat a strip of land in the

Thompson Addition to the City of Bozeman to be known as Thompson Addition
No.2 to Bozeman, Montana; that said plat containing approximately 9.5
acres more or less;
That the Parties of the Second Part have required a s condition to
accepting the plat of said Thompson Addition No.2, that the Party of the First
Part agreer in connection with platting the remaining portions of said lands
owned by First Party, that First Party dedicate one-nineth (1/9) of the total area
of said lands hereinbefore set out and owned by First Party t exclusive of streets
and alleys when plattedr to be set aside for park purposes;
That in consideration of this agreementt Second Parties are willing
to waive the requirement that one-ninth (1/9) of the area contained in said plat
to be known as Thompson Addition No.2 of the City of Bozeman be set aside for
park area at this time.
NOWr THEREFORE! in consideration of the Parties of the Second
Part permitting the Party of the First Party to file said plat of Thompson Addition
No.2 to the City of Bozeman, Montana, without setting aside a portion of said
lands included in said plat for park purposest Party of the First Part hereby
covenants and agrees that if and when the above described lands less Thompson
and less Thompson Addition No.3 to City of R:.zmm
Addition No.. 2 to the City of Bozeman,/owned by the First Party, are plattedt
that there shall be included in the plat such area for park purposes as the laws
of Montana may require I not exceeding, however ,one-ninth (1/9) of the total
area of the lands herein described now o'Wrled by First Party I including the land
platted and Thompson Addition No. 2 to Bozeman, Montana, exclusive of streets -
and alleys I when platted.
THIS AGREEMENT shall constitute a lien upon the lands herein
describedr owned by First Party, for park purposes as hereinbefore provided I
exclusive of lands in said Thompson Addition No.2, and shall bind the successors
and assigns of the Party of the First Part;
