Subject: Notice of Award to Central Excavation Inc. in the amount of
$621,143.00 for the Sunset Hills Cemetery and Lindley Park Water
Conservation Project

Recommendation: Authorize the City Manager to sign a Notice of Award for construction of
the Sunset Hills Cemetery and Lindley Park Water Conservation Project to Central Excavation
Inc., in the amount of $621,143.00 as well as the final contract documents, once received.
Background: The Sunset Hills Cemetery and Lindley Park Water Conservation Project will
conserve treated water supplies, reduce annual City expenses associated with the cost of
irrigation water, increase availability of domestic water supplies during periods of drought,
reduce safety risks to city staff associated with the existing Bozeman Creek diversion structure,
allow for fish passage in Bozeman Creek and increase instream flows for fish habitat. Total
water savings realized upon completion of this project equal 1,141 acre-feet per year. These
savings include 1,082 acre-feet of additional water supplies to be kept in Bozeman Creek, 34.3
acre-feet of treated water conserved, and 25 acre-feet of groundwater supplies conserved.
On February 6, 2019, the City Clerk opened six bids for construction of the Project. The scope
of the Project includes the construction of a replacement point of diversion (POD) with
automated controls on Bozeman Creek, installation of a gravity pipeline to transport water from
the replacement POD to a pump station, installation of a pump station, and installation of a
pressure pipeline connecting the pump station to the existing irrigation system at Sunset Hills
Cemetery and Lindley Park.
Central Excavation, Inc., submitted the low bid of $617,243.00 for the base bid and $3,900.00
for additive alternate 1, which includes the demolition of the existing diversion structure, for a
total bid price of $621,143.00. City staff and the Project Engineer with Morrison-Maierle Inc.
reviewed the bid and found Central Excavation, Inc. to be qualified to complete the work, found

no discrepancies in the bid and found prices reasonable and in-line with the engineer’s cost
estimate.
Alternatives: As suggested by the Commission.
Fiscal Effects: The Sunset Hills Cemetery and Lindley Park Water Conservation Project is
budgeted for in the approved FY-20 Capital Improvement Plan. An additional $300,000 in grant
funding from the Bureau of Reclamation’s WaterSMART Grant Program and $125,000 in grant
funding from the Department of Natural Resources and Conservation Renewable Resource Grant
and Loan Program has been secured for this project.

Successful Bidder and are awarded a Contract for the Base Bid Project and Additive Alternate No. 1.
The Contract Price of your Contract is Six Hunderd Twenty One Thousand One Hundred Forty Three and No
One Hundreths Dollars ($621,143.00).
6 copies of each of the proposed Contract Documents (except Drawings) accompany this Notice of Award.
3 sets of the Drawings will be delivered separately or otherwise made available to you immediately.
You must comply with the following conditions precedent within fifteen days of the date you receive this Notice of
Award.
1. Deliver to the Owner [6] fully executed counterparts of the Contract Documents.
2. Deliver with the executed Contract Documents the Contract security [Bonds] as specified in the
Instructions to Bidders (Article 20), [and] General Conditions (Paragraphs 2.01 and 5.01) [and
Supplementary Conditions (Paragraph SC-2.01).]
3. Other conditions precedent:
Submit preliminary Project Schedule concurrently with contract documents.
Failure to comply with these conditions within the time specified will entitle Owner to consider you in default,
annul this Notice of Award and declare your Bid security forfeited.
Within fifteen days after you comply with the above conditions, Owner will return to you two fully executed
counterparts of the Contract Documents.
