Dear Interested Party:
The Board of Environmental Review("board")and the Department of Environmental Quality
("department") have proposed adding add six new human-health ground water criteria into
Department Circular DEQ-7 Montana Numeric Water Quality Standards("DEQ-7"). The
proposed criteria are for: diallate; dioxane, 1,4-; iron; manganese; perfluorooctane sulfonate
(PFOS);and perfluorooctanoic acid (PFOA). The proposed criteria concentrations are as follows:
diallate,5.5 µg/L; dioxane, 1,4-, 3 µg/L; iron,4000 µg/L; manganese, 100 µg/L; PFOS,0.07 µg/L;
and PFOA,0.07 µg/L.
DEQ-7 is incorporated by reference into the Administrative Rules of Montana (ARM),so the
rulemaking includes updates to DEQ-7 where it is cited in the ARM. The circular is incorporated
into the following ARM: 17.24.645; 17,24.646; 17.30.502; 17.30.619; 17.30.702; 17.30.1001;
17.36.345; 17.55.109; 17.56.507;and 17.56.608.
The board and department held a public hearing on the rulemaking on February 5, 2019. The
proposed rulemaking generated more comments than anticipated, mainly in regards to
manganese. For that reason, on March 19, 2019, at 2:00 p.m.,the board and department will
hold an additional public hearing in Room 111 of the Metcalf Building, 1520 East Sixth Avenue,
Helena, Montana,and have extended the public comment period for an additional 45 days.
A copy of the Montana Administrative Register(MAR) notice of proposed rulemaking has been
enclosed for-your consideration. The draft version of Circular DEQ-7 may be found on the
department's website at http://deq.mt.gov/water/drinkingwater/standards.
The board and department will make reasonable accommodations for persons with disabilities
who wish to participate in this rulemaking process or need an alternative accessible format of
this notice. Concerned persons may submit their data,views,or arguments at the hearing,or in
writing no later than March 25, 2019. Please see the enclosed MAR notice for details.

1. On December 21, 2018, the Board of Environmental Review and the
Department of Environmental Quality published MAR Notice No. 17-403 pertaining
to the public hearing on the proposed amendment of the above-referenced rules at
page 2446 of the 2018 Montana Administrative Register, Issue Number 24.
2. The proposed rulemaking has generated more comments than anticipated.
For that reason, on March 19, 2019, at 2:00 p.m., the Board of Environmental
Review and the Department of Environmental Quality will hold an additional public
hearing in Room 111 of the Metcalf Building, 1520 East Sixth Avenue, Helena,
Montana, and extend the public comment period for an additional 45 days.
3. Concerned persons may submit their data, views, or arguments, either
orally or in writing, at the hearing. Written data, views, or arguments may also be
submitted to Sandy Scherer, Legal Secretary, Department of Environmental Quality,
1520 E. Sixth Avenue, P.O. Box 200901, Helena, Montana 59620-0901; faxed to
(406) 444-4386; or e-mailed to sscherer@mt.gov, no later than 5:00 p.m. March 25,
2019. To be guaranteed consideration, mailed comments must be postmarked on or
before that date.
4. The board and department will make reasonable accommodations for
