FY 1985 SERVICE AGREEMENT
THIS AGREEMENT, of September 4, 1984, is made by and between ON CAMPUS LIVING,
MONTANA STATE UNIVERSITY at Bozeman, Montana, hereinafter referred to as "OCLlMSU",
and the CITY OF BOZEMAN in Montana, hereinafter referred to as IICITY".
In accordance with the recommendations of Fire Protection Analysis, Inc. of Great
Falls, Montana in their report entitled IIAN EVALUATION of LIFE SAFETY AND FIRE
PROTECTION for MONTANA STATE UNIVERSITY ON CAMPUS HOUSING HIGH RISE STRUCTURES"
it is the interest and intent of OCL/MSU to provide support for the employment
of additional CITY fire fighting personnel so that Station #2 can be operated on
a full-time basis. This support will not include the provision of any state-
appropriated funds to subsidize the cost of current services to Montana State
University by the Bozeman Fire Department. This support will be from auxiliary
revenues for additional services which will enhance the level of fire safety in
the OCL/MSU facilities.
Both parties are desirous of accommodating the above-described concerns; and
pursuant to th~s desirp, have acreed as follows:
l. The conditions of this agreement shall be in accordance with the
general intent expressed in the IIMemorandum of Understanding for
Support of Personnel at Station #211, attached as Exhibit 1.
2. The term of this agreement shall be from September 17, 1984, to
June 3D, 1985. This agreement shall expire on June 30, 1985,
unless extended by mutual written agreement of the parties before
June 1, 1985.

3. On or before September 17, 1984, the CITY shall employ sufficient
personnel to initiate operations in Station #2 in such a manner
as to provide service to its first-call area, which includes the
OCL/MSU facilities, on a full-time basis.
4. In addition to fire fighting services, the personnel at Station
#2 will devote a sufficient percentage of their time, upon request
of OCL/MSU, to provide for all necessary fire prevention activities,
including staff training, escape routes, drill procedures, equip-
ment recommendations and similar activities in the OCL/MSU facilities.
5. Pursuant to Article 4, prior to the opening of OCL/MSU residence
halls on September 15, 1984, the CITY fire fighting personnel will
cooperate with OCL/MSU personnel in the annual Fire Safety and
Evacuation Training Seminar for all 1984-85 OCL/MSU Residence Hall
Advisors.
6. During the term of this agreement OCL/MSU shall contribute to the
cost of wages, benefits and retirement contributions for those
personnel operating Station #2. The level of this support shall not
exceed $70,000 per annum, or on a prorated basis, $55,426 during the
10.5 month term of this agreement.
7. The CITY will bill OCL/MSU quarterly, in advance, according to the
following schedule:

Each invoice shall provide a detailed statement,
by person and item, of anticipated costs of operation
for the coming quarter. If anticipated cost varies
from the actual cost, an adjustment will be made in
the next billing.
8. On or before January 2, 1985, the CITY shall purchase five (5)
Hi-Rise Hose Pac IS, each consisting of (1) Zico AWP-B wheeled
pac with lid, (150') Snap-Tite 211 poly lined fire hose and (1)
Task Force HTFT-VPG 50-350 Nozzle. Upon receipt, CITY shall
mount these to fire trucks and maintain same for use on fires
both at OCL/MSU and throughout the City of Bozeman.
9. Upon receipt of proof-of-purchase, OCL/MSU shall promptly reim-
burse CITY for the above-listed equipment in an amount not to
exceed $6,875.
10. On or before March 4, 1935, the CITY shall submit to OCL/MSU a
SEMINAR PROPOSAL, to be coordinated by the Montana Fire Service
Academy and sponsored by OCL/MSU. This seminar shall concentrate
on all aspects of high-rise fire-fighting operations. It shall
be for the particular benefit of CITY personnel, but open to
attendance by personnel of other communities.

.: 11. To accomodate a timely renewal of this agreement, or or before .
April 5, 1985, the CITY shall submit to OCL/MSU an FY'86 OPERATIONS
COST PROPOSAL and FIVE YEAR CAPITAL nn1S PLAN for Station #2, for
review and use in preparing the succeeding annual agreement.
12. This agreement may, at the option of either of the parties, be
terminated and/or otherwise voided in either the event that the
first-call area of Station #2 is not operated on a full-time
status or the event that the State of Montana decides to provide
City services support through payments in lieu of taxes.
IN WITNESS WHEREOF, the parties have entered into this agreement the date first
above appearing.

Memorandum of Understanding
SUPPORT OF FIRE PERSONNEL AT STATION 12
Montana State University/On Campus living wishes to express the interest and
intent of joining with the City of Bozeman to provide long-term support for
the employment of additional Bozeman fire fighting personnel so that Station
#2 can be operated on a full-time basis. This support will not include the
provision of any state-app~opriated funds to subsidize the cost of current
services to MSU by the Bozeman Fire Department. This support will be from
auxiliary revenues for additional services which will enhance the level of
fire safety in our auxiliary facilities.
The sped fic elements which must be recognized as conditions of our intent
are as follows:
1. Actual support shall be detailed and formalized, on an annual
basis, through a signed agreement between the Bozeman City
Manager and the MSU/OCl Director, with endorsements by the
president of Montana State University and the mayor of Bozeman.
2. For any given year, the level of contribution from MSU shall not
exceed that shown, in 1985 dollars, on the schedule attached
hereto as Exhibit A.
A. After FY-85 (July I, 1984 through June 30, 1985), the
actual level of contribution for personal services will
be determined, on an annual basis, by adjusting the
amounts shown to reflect yearly wage/benefits/retirement
increases provided to fire personnel through their
contract with the city.
B. After FY-85, the actual level of contribution for
capital will be determined through review of the city's
proposed five-year capital items plan and its
relationship to the operation of Station #2 and fire
safety in OCl facilities.
3. This Memorandum of Understanding and any agreement entered into
hereunder may, at the option of either of the parties, be
terminated and/or otherwise voided in the event that the first-
call area of Station 12 is not operated at substantially full-time
status or in the event the State of Montana decides to provide
city services support through payments in lieu of taxes.
4. In addition to fite-fighting services, the personnel at Station 12

escape routes, drill procedure, equipment recommendations, and
similar activities on campus. These services and the
administrative relationship under which they will be performed
will be reviewed and become part of the agreements signed each
year.
5. The MSU contribution of FY-85 will not be firmly established until
such time that new personnel have been employed and the service of
the first-call area of Station 12 on a full-time basis is begun.
6. The city shall bill MSU quarterly in advance in the amount of the
anticipated actual cost for the coming quarter. If the
anticipated actual cost varies from the actual cost, an adjustment
will be made in a subsequent billing.
7. During fiscal year 1989, this document will be reviewed by both
parties to identify any appropriate adjustments in participation.
